September 26, 2023 <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the conveyance of the requested <br />easements to the Commonwealth of Virginia, and that the City Manager is hereby <br />authorized to execute such documents or instruments as may be necessary or desirable <br /> <br />in furtherance of the intent of this Resolution.” <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />- New Business - <br /> <br />23 - 308 - Boards and Commissions <br /> <br /> <br /> There were no appointments. <br /> <br />23 - 309 - Items Submitted by Council Members <br /> <br /> Adoption of an ordinance to amend and reordain Chapter 2 (administration) of the <br />Code of the City of Portsmouth, Virginia by adding a new Article XXI establishing the <br />Crime and Gun Violence Commission. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Tillage, to defer the above ordinance <br />to the October 10, 2023, City Council meeting, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br /> Dr. Whitaker asked for and received a consensus of City Council to place an item <br /> <br />on the October 10, 2023, City Council agenda to reappropriate $11 million back to <br />the schools. There was also a request to have Superintendent Bracy provide a <br />presentation at the Public Work Session. <br /> <br /> Dr. Whitaker provided a letter from the Department of Taxation and asked that it be <br /> <br />placed in the minutes. He also asked that City Attorney Graham-Wiliams provide a <br />report back on how to recoup funds from Elizabeth Manor Golf course for the years <br />they did not pay taxes to the City. <br /> <br />Letter from the Department of Taxation: <br /> <br />Dear Dr. Whitaker: <br /> <br />Per your request, I have reviewed the real property assessment and subsequent tax <br />calculation of the Elizabeth Manor Golf and Country Club (City of Portsmouth TMP: <br />0612-0010) based on the documentation that you provided. Below is a summary of my <br />conclusions. <br /> <br />BACKGROUND <br /> <br />The Elizabeth Manor Golf and Country Club is a private club located within the City of <br />Portsmouth. At some point, the City determined that it was in the public interest that the <br />subject property be preserved and entered into an Open Space Use agreement with the <br />property owner. <br /> <br />I reviewed copies of recorded open-space agreements you provided dated July 22, <br />1996; July 1, 2002; September 1, 2009; and January 6, 2020. However, it is my <br />understanding that the City and property owner originally recorded an Open Space <br />agreement in 1979.
