September 26, 2023 NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby approves and authorizes the conveyance of the requested easements to the Commonwealth of Virginia, and that the City Manager is hereby authorized to execute such documents or instruments as may be necessary or desirable in furtherance of the intent of this Resolution.” Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None - New Business - 23 - 308 - Boards and Commissions  There were no appointments. 23 - 309 - Items Submitted by Council Members Adoption of an ordinance to amend and reordain Chapter 2 (administration) of the Code of the City of Portsmouth, Virginia by adding a new Article XXI establishing the Crime and Gun Violence Commission. Motion by Mr. Moody, and seconded by Mr. Tillage, to defer the above ordinance to the October 10, 2023, City Council meeting, and was adopted by the following vote: Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover Nays: None Dr. Whitaker asked for and received a consensus of City Council to place an item  on the October 10, 2023, City Council agenda to reappropriate $11 million back to the schools. There was also a request to have Superintendent Bracy provide a presentation at the Public Work Session. Dr. Whitaker provided a letter from the Department of Taxation and asked that it be  placed in the minutes. He also asked that City Attorney Graham-Wiliams provide a report back on how to recoup funds from Elizabeth Manor Golf course for the years they did not pay taxes to the City. Letter from the Department of Taxation: Dear Dr. Whitaker: Per your request, I have reviewed the real property assessment and subsequent tax calculation of the Elizabeth Manor Golf and Country Club (City of Portsmouth TMP: 0612-0010) based on the documentation that you provided. Below is a summary of my conclusions. BACKGROUND The Elizabeth Manor Golf and Country Club is a private club located within the City of Portsmouth. At some point, the City determined that it was in the public interest that the subject property be preserved and entered into an Open Space Use agreement with the property owner. I reviewed copies of recorded open-space agreements you provided dated July 22, 1996; July 1, 2002; September 1, 2009; and January 6, 2020. However, it is my understanding that the City and property owner originally recorded an Open Space agreement in 1979. All the agreements that I reviewed generally include the same terms:
