May 23, 2023 <br /> <br />IT BEING all that certain property conveyed to Economic Development Authority of the <br />City of Portsmouth, Virginia by Deed of Bargain and Sale from Ten River Lots, LLC dated <br />August 15, 2016 and recorded in the Portsmouth Circuit Court Clerk’s Office as <br />Instrument Number 160008062. <br /> <br /> 6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development shall be in substantial compliance with the concept plan entitled <br />A4 Landing at High Street prepared by Hoggard-Eure Associates, PC dated March 14, <br />2023, except as otherwise expressly stated in this Section 6 or where modifications are <br />required to comply with all applicable local, state and federal codes and regulations. <br /> <br /> (b) The development shall be in substantial compliance with the rendered concept <br />elevations and proposed materials board titled titled Kings Landing at High Street <br />Townhomes prepared by Retnauer Baynes Associates, LLC dated December 16, 2022, <br />except where modifications may be required to comply with all applicable local, state, and <br />federal codes and regulations. <br /> <br />(c) Townhouse dwelling lots shall be subdivided in accordance with Chapter 33.1 of <br />the City Code (Subdivision Ordinance) prior to Site Plan review approval. <br /> <br />(d) Not more than 52 townhouse dwelling units shall be constructed and operated on <br />the subject property. <br /> <br />(e) The development must include a minimum of two (2) pedestrian access paths <br />along High Street to ensure adequate pedestrian connectivity and accessibility to the <br />public right-of-way. <br /> <br />(f) The development shall include streetscape improvements along all street <br />frontages, including those consistent with the current Complete High Street Innovation <br />Corridor Multimodal Concept Plan, subject to any deviations approved by the City <br />Engineer. <br /> <br />(g) Vegetation shall be installed in accordance with Section 40.2-304 of the Zoning <br />Ordinance, to include native landscaping that provides a fully opaque screen to the <br />minimum height necessary to fully screen the development’s BMP from the public right- <br />of-way. The plan and design for vegetation must be approved by the Zoning Administrator <br />prior to Site Plan review approval. <br /> <br />(h) The development shall be constructed in compliance with all applicable codes, <br />ordinances and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained and remain in effect during the operation of the <br />development. <br /> <br />(i) All taxes/fees associated with the property and/or the proposed use must be paid <br />when due, as determined by the City Treasurer. <br /> <br />(j) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the Zoning <br />Ordinance, which provides that this Use Permit may automatically expire and become <br />void if certain conditions set forth therein are not satisfied within two (2) years from the <br />date of approval by City Council. <br /> <br />7. Use Permit UP-21-09 approved by Resolution R-21-13 adopted by City <br />Council on June 22, 2021 is superseded in its entirety by this Use Permit UP-23-05, and <br />Use Permit UP-21-09 shall be of no further force or effect. <br /> <br />REVOCATION OF PERMIT: <br />8. Violation of any of the conditions set forth <br />herein may serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br /> <br /> <br /> <br />
