Donna Biggs, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />Motion by Mr. Tillage, and seconded by Mr. Hugel, to defer CA-22-01 to the May <br />23, 2023, City Council meeting, and was adopted by the following vote: <br /> <br />Ayes: Barnes, Hugel, Lucas-Burke, Moody, Tillage, Whitaker, Glover <br />Nays: None <br /> <br />(b) Z-23-01 DEEP CREEK BLVD. - Ordinance granting the request of David <br />Perry Realty LLC, on behalf of Dollhouse Investments LLC, to <br />rezone the approximately 0.81-acre property at 5125/5129 Deep <br />Creek Boulevard from General Mixed-Use (GMU) to Multi-Family <br />Urban Residential (UR-M) in order to subdivide the property and <br />develop three single-family dwellings. The Future Land Use Map of <br />the Build One Portsmouth Comprehensive Plan designates this <br />property as Commercial. The property is owned by Dollhouse <br />Investments LLC. Planning Commission recommends approval. <br /> <br />1. The Future Land Use Map of the Build One <br />Portsmouth Comprehensive Plan designates this property as a <br />Mixed-Use Corridor. The properties are owned by Keith Alexander. <br />Planning Commission recommends approval with conditions. <br /> <br />1. Robert Simon, 2589 Quality Court, Virginia Beach, presented the application. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Tillage, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-23-01) TO CONSTRUCT NOT MORE <br />THAN SEVEN TOWNHOUSES AT 3614 RACE STREET AND 1211 RODMAN AVENUE <br />(TAX PARCELS 0314-0550 AND 0314-0560). <br /> <br /> <br />WHEREAS <br /> , Gregory Milstead, P.E., agent for Keith Alexander, the owner of the <br />subject property, has made application pursuant to Section 40.2-533 of the Code of the <br />City of Portsmouth, Virginia for the granting of a use permit to construct not more than <br />seven townhouses at 3614 Race Street and 1211 Rodman Avenue (Tax Parcels 0314- <br />0550 and 0314-0560); and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with the application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the approval with <br />conditions of the application for a use permit. <br /> <br /> <br /> <br /> <br /> <br />
