April 11, 2023 <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it has reviewed and considered the application materials, the City staff <br />report, the proceedings and recommendation of the Planning Commission, all comments <br />made at the public hearing, and the discussion of the Council regarding the application. <br /> <br /> 2. That it has considered factors it deemed applicable and consistent with the <br />Code of Virginia, which may include, without limitation, the nature, extent, external effects, <br />location, design or method of operation of the requested use, the City’s comprehensive <br />plan, and the public health, safety, and general welfare. <br /> <br /> 3. That it has considered the imposition of conditions regarding the location, <br />character, and other features of the proposed use and finds and determines that the <br />conditions imposed by this Resolution are necessary to ensure compliance with the <br />general intent and purposes of the Zoning Ordinance and to prevent or minimize adverse <br />effects from the proposed use. <br /> <br /> 4. That based on its review and consideration, it has determined that the use <br />GRANTED WITH CONDITIONS <br />permit requested by the subject application should be <br />as provided in this Resolution. <br /> <br /> 5. That a use permit is hereby granted pursuant to Section 40.2-533 of the <br />Code of the City of Portsmouth, Virginia to construct not more than seven townhouses at <br />3614 Race Street and 1211 Rodman Avenue (Tax Parcels 0314-0550 and 0314-0560), <br />the said property being more particularly described as: <br /> <br />UP-23-01 <br /> <br />3614 Race Street <br />(Tax Parcel 0314-0550) <br /> <br />ALL THAT certain parcel of land with the buildings and improvements thereon situated in <br />the City of Portsmouth, Virginia and known as 3614 Race Street, composed of Lots 16, <br />18, and Part of Lot 20, in Block 188, on the plat of VIRGINIA REALTY AND INVESTMENT <br />COMPANY, of record in the Clerk’s Office of the Circuit Court of the City of Chesapeake, <br />Virginia, in Map Book 7, at Pages 98, 99 and 100, the parcel being described as follows, <br />to-wit: BEGINNING at an iron pin on the northern line of Race Street distant 72.25 feet in <br />an easterly direction as measured along this line of Race Street from the northeast corner <br />of Rodman Avenue and Race Street; thence easterly along this line of Race Street 77.75 <br />feet to a pin; thence north 2 degrees 2 minutes, east 108.50 feet to a pin; thence north 87 <br />degrees 58 minutes west 65.21 feet to a pin; thence south 2 degrees 2 minutes west <br />23.99 feet to a pin; thence south 47 degrees 2 minutes west 17.73 feet to a pin; thence <br />south 2 degrees 2 minutes west 71.97 feet to the northern line of Race Street the point of <br />beginning. <br /> <br />IT BEING “Parcel Two” of that property conveyed by that Deed from Atlas NC I SPE, LLC <br />to Keith Alexander dated November 1, 2019 and recorded in the Clerk’s Office of the <br />Circuit Court for the City of Portsmouth, Virginia as Instrument Number 190011425. <br /> <br />1211 Rodman Avenue <br />(Tax Parcel 0314-0560) <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, and the appurtenances thereunto belonging, situate, lying and being in the City <br />of Portsmouth, Virginia, and known as 1211 Rodman Avenue, composed of Lots 22 and <br />24 and Part of Lot 20, in Block 188, on the plat of VIRGINIA REALTY AND INVESTMENT <br />COMPANY of record in the Clerk’s Office of the Circuit Court of the City of Chesapeake, <br />Virginia, in Map Book 7, at Pages 98, 99 and 100, the parcel being described as follows, <br />to-wit: BEGINNING at the northeast intersection of Rodman Avenue and Race Street, <br />and from thence running east along the north side of Race Street 72.25 feet to an iron <br />pin; thence north 2 degrees 2 minutes east, parallel with Rodman Avenue, 71.97 feet to <br /> <br /> <br /> <br /> <br />
