<br />"A RESOLUT%ON GRANTING A USE PERMIT TO THE SALVATION A~Y TO OPERATE AN ADULT DAY
<br />CARE CENTER AT 2306 AIRLINE BOULEVARD.
<br />
<br /> WHEREAS, the Salvation Army, a Georgia Corporation, has made application pursuant to
<br />640-76 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of
<br />a use permit as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all thin~s required to be done
<br />in connectiOn with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the ~ranting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code.
<br />
<br /> 2. The Salvation Army is hereby granted a use permit pursuant to 640-76 (b) of the Code
<br />of the City of Portsmouth, Virginia to operate an adult day care center for fifteen adults at
<br />2306 Airline Boulevard (UP-85-34).
<br />
<br />3. This use permit is approved subject to the following conditions:
<br />
<br /> (a) The adult day care center may be operated with an enrollment of not more than
<br />fifteen (1S) adults to be cared for at the facility at any one time.
<br />
<br />(b) All operations shall be conducted between the hours of 6:00 a.m. and 6:00 p.m.
<br />
<br /> (c) A passive outdoor recreation area Shall be provided and a privacy fence ereCted
<br />screening the recreation area from the adjoining school playground.
<br />
<br /> (d) The applicant shall comply with all applicable codes, ordinances, policies and
<br />regulations of federal, state~ and local governments and shall obtain all necessary licenses
<br />and permits.
<br />
<br /> (e) The use permit is i~ssued to the Salvation Army, a Georgia Corporation, for 2306
<br />Airline Boulevard, and is not transferable to any other person, entity, or location.
<br />
<br />4. This resolution shall take effect as of the date of its adoption."

<br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, that Items 86~28 (b) and (c) be con-
<br />sidered together, and was adopted by unanimous vote.
<br />
<br /> Jim Wayland, 309 County Street and Michael Blachman, Attorney, 505 Court Street, repre-
<br />senting Metro Development Corporation; spoke for the application and was available to answer
<br />any questions.
<br />
<br /> Richard Carmichael, 723 Nottingham Road, spoke in opposition of Items (b) and (c).
<br />
<br /> Mrs. Clarence Hayden, 710 Nottingham Road, spoke in opposition of the applications and
<br />related to the number of cars and children that would be involved.
<br />
<br /> Clarence Hayden, 710 Nottingham Road, spoke in opposition to the high density on Elmhurst
<br />Lane.
<br />
<br /> Motion of Mr. Whitlow and seconded by Mrs. Webb, to
<br />mendation, the following ordinance was approved on first
<br />vote:
