LANGLEY FOR THE CONVERSION OF AN EXISTING VACANT COMMERCIAL STRUCTURE TO A DUPLEX RESIDENCE AT 349-51 MARYLAND AVENUE iUP-85-33~ . WHEREAS, Z. L. Langley, has made application pursuant to Section 40-102 (B) for a use permit to convert an existing vacant commercial structure to a duplex residence at 349-51 Maryland Avenue which is located in the Port Norfolk Historic District; and WHEREAS, the applicanz and the Planning Director have done all things required ro be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with condi- tions for the conversion of an existing vacant commercial structure to a duplex residential structure. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a] Will not adversely affect the health and safety of persons residing in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and c) Will be in accord with the purpcses of the Zoning Chapter of the City Code. 2. S. L. Langley is hereby granted a use permit pursuant to Section 40-102 (B) to conver an existing vacant commercial structure to a duplex residential structure at ~49-51 Maryland Avenue, such conversion to be in compliance with the regulations applicable to the Port Norfol Historic Residential Subdistrict as provided for in the Zoning Chapter of the Code of the City of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the followin terms and conditions: [a) The applicant shall comply with all applicable codes, ordinances, regulations of the City of Portsmouth, Virginia, and shall obtain all necessary permits. Ray has made application pursuant to ~40-70 (b] of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use oermit to operate a child care centex at 629? Portsmouth Boulevard; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit for operation of a child care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: the 1. That the use for which the use permit ~s sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b] Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Naomi M. Ray is hereby granted a use permit pursuant to ~40-70 (b) of the City Code to operate a child care center at 6297 Portsmouth Boulevard [UP-85-35' . 3. The use permin is approved subject to the following conditions: (a. The child care center may be operated with an enrcllment of not more than twenty five (25) children to be cared for at the facility at any one time. (b) All outdoor play activities shall be conducted within a fenced play area and benween the hours of 8:00 a.m. and 6:00 ~.~. ~th~ no more than sixteen [16) children outside a any one ~ime. A five foot _S') high wooden fence shall be installed to enclose the proposed rear play area.
