LANGLEY FOR THE CONVERSION OF <br />AN EXISTING VACANT COMMERCIAL STRUCTURE TO A DUPLEX RESIDENCE AT 349-51 <br />MARYLAND AVENUE iUP-85-33~ . <br /> <br /> WHEREAS, Z. L. Langley, has made application pursuant to Section 40-102 (B) for a use <br />permit to convert an existing vacant commercial structure to a duplex residence at 349-51 <br />Maryland Avenue which is located in the Port Norfolk Historic District; and <br /> <br /> WHEREAS, the applicanz and the Planning Director have done all things required ro be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of a use permit with condi- <br />tions for the conversion of an existing vacant commercial structure to a duplex residential <br />structure. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a] Will not adversely affect the health and safety of persons residing in the <br />neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />c) Will be in accord with the purpcses of the Zoning Chapter of the City Code. <br /> <br /> 2. S. L. Langley is hereby granted a use permit pursuant to Section 40-102 (B) to conver <br />an existing vacant commercial structure to a duplex residential structure at ~49-51 Maryland <br />Avenue, such conversion to be in compliance with the regulations applicable to the Port Norfol <br />Historic Residential Subdistrict as provided for in the Zoning Chapter of the Code of the City <br />of Portsmouth, Virginia, 1973, as amended, such approval being granted subject to the followin <br />terms and conditions: <br /> <br /> [a) The applicant shall comply with all applicable codes, ordinances, <br />regulations of the City of Portsmouth, Virginia, and shall obtain all necessary <br />permits. <br /> <br /> [b) The applicant shall comply with the approval of the Commission of <br />Review in all its detail. <br /> <br />policies and <br />licenses and <br /> <br />Architectural <br /> <br />This resolution shall take effect immediately upon it adoption." <br /> <br />(fl <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO NAOMI M. RAY 70 CPERATE A CHILD CARE <br />CENTER AT 6297 PORTSMOUTH BOULEVARD [UP-85-351 . <br /> <br /> WHEREAS, Naomi M. Ray has made application pursuant to ~40-70 (b] of the Code of the City <br />of Portsmouth, Virginia, 1973, for the granting of a use oermit to operate a child care centex <br />at 629? Portsmouth Boulevard; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of a use permit for <br />operation of a child care center. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />the <br /> <br />1. Naomi M. Ray is hereby granted a use permit pursuant to ~40-70 (b) of the City Code <br />to operate a child care center at 6297 Portsmouth Boulevard [UP-85-35' . <br /> <br />3. The use permin is approved subject to the following conditions: <br /> <br /> (a. The child care center may be operated with an enrcllment of not more than twenty <br />five (25) children to be cared for at the facility at any one time. <br /> <br /> (b) All outdoor play activities shall be conducted within a fenced play area and <br />benween the hours of 8:00 a.m. and 6:00 ~.~. ~th~ no more than sixteen [16) children outside a <br />any one ~ime. A five foot _S') high wooden fence shall be installed to enclose the proposed <br />rear play area. <br /> <br /> <br />
