<br />the plat of Barrett and Syer, duly recorded in the Clerk’s Office of the Circuit Court of the
<br />City of Chesapeake, Virginia, in Map Book 3, page 42, to which said plat reference is
<br />hereby made for a more complete description of said property, the same fronting ninety
<br />(90’) feet, more or less, on the south side of Turnpike Road.

<br />IT BEING a portion of the property conveyed by Quitclaim Deed from the Commonwealth
<br />of Virginia to the City of Portsmouth, Virginia dated August 22, 2018 and recorded in the
<br />Clerk’s Office of the Circuit Court for the City of Portsmouth, Virginia as Instrument
<br />Number 190001533.

<br /> 6. That the use permit is approved subject to the following conditions which
<br />shall be observed by the applicant and any successor in interest:
<br />
<br />(a) The development shall be in substantial compliance and conformity with the
<br />concept plan entitled “Rezoning Exhibit LBC Transportation, LLC” prepared by Hoggard-
<br />Eure Associates, P.C. and dated October 18, 2022, except where modifications may be
<br />required due to improvements recommended by the Traffic Impact Analysis described
<br />below or to comply with applicable local, state, or federal codes or regulations.
<br />
<br />(b) The approved use shall be designed and operated in accordance with the use-
<br />specific standards for shipping container/chassis storage yard uses outlined in Section
<br />40.2-217(H)(3)(b) of the Zoning Ordinance.
<br />
<br />(c) A Traffic Impact Analysis satisfying and in accordance with the requirements of
<br />Section 40.2-545 of the Zoning Ordinance shall be prepared and submitted as part of the
<br />Site Plan Review submission for the development. Furthermore, the owner/operator of
<br />the development, at no cost to the City, shall comply with the recommendations included
<br />in the Traffic Impact Analysis as approved by the City Engineer, whether on-site or off-
<br />site.
