December 13, 2022 <br /> <br />(d) Prior to Site Plan Review approval, the owner/operator of the development shall <br />cause preparation of a Minor Subdivision plat combining the parcels subject to this use <br />permit into one parcel in accordance with the standards and requirements set forth in <br />Chapter 33.1 of the City Code and, after approval of the plat by the City, the <br />owner/operator shall cause the plat to be recorded in the land records. <br /> <br />(e) Prior to commencing any permanent activities associated with the use approved <br />hereby, the existing barbed wire fence shall either be removed or replaced with a fence <br />that complies with the standards in Section 40.2-305 of the Zoning Ordinance. <br />Alternatively, the applicant may submit a security plan requesting approval of a barbed <br />wire fence. Should the security plan be denied, the existing barbed wire fence shall be <br />removed by the owner/applicant and replaced with a fence that complies with the <br />standards in Section 40.2-305 of the Zoning Ordinance. <br /> <br />(f) A Type D Option 1 landscape buffer shall be installed where the development <br />abuts Turnpike Road in accordance with Section 40.2-304 of the Zoning Ordinance. <br /> <br />(g) Prior to initially operating the approved use and so long as the use remains in <br />operation, the owners and/or operators shall install and maintain digital video equipment <br />with recording capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing the front, side, <br />and rear exteriors of the property for 24 hours a day, 7 days a week. Recorded data must <br />be maintained in a condition permitting review of the information for a period of no less <br />than thirty days. <br /> <br />(h) If, at any point in the future, Spruce Street is proposed to be used for <br />ingress/egress, the applicant shall fully improve and widen the right-of-way in accordance <br />with current Department of Engineering standards. All such improvements and widening <br />must be reviewed and approved by the Department of Engineering prior to any use of the <br />said right-of-way for ingress/egress. <br /> <br />(i) If any building is constructed or placed on the site at any point in the future, off- <br />street parking in accordance with Section 40.2-301 of the Zoning Ordinance shall be <br />installed and maintained. <br /> <br />(j) The development shall be constructed in compliance with all applicable codes, <br />ordinances, and regulations of federal, state and local government, and all required <br />licenses and permits shall be obtained prior to construction and remain in effect during <br />the operation of the development. <br /> <br />(k) All taxes/fees associated with the property and/or the proposed use must be <br />paid when due, as determined by the City Treasurer. <br /> <br />(l) Except as provided in Section 40.2-533(K)(2) and (3) of the Zoning Ordinance, this <br />Use Permit shall automatically expire and become void two (2) years after the date of <br />approval by City Council if the use hereby authorized is inactive or changed to a different <br />use, unless within such two (2) year period: (i) a building permit is obtained and erection <br />or alteration of a structure is started; or (ii) a Certificate of Occupancy is obtained and the <br />use hereby authorized is commenced. This condition is included for notice purposes and <br />is not intended to modify Section 40.2-533 of the Zoning Ordinance, and it shall be <br />construed accordingly. <br /> <br />(m) No stacking of shipping containers is permitted anywhere on the subject property. <br /> <br />REVOCATION OF PERMIT: <br />7.
