Wayland, Jr., Secretary-Treasur <br /> for 28 condominium units at northwest corner of Airline Boulevard and <br /> Elmhurst Lane, approved on first reading at the regular meeting of <br /> February 11, 1986 for 20 units per acre. <br /> <br /> On motion of Mr. Beamer and seconded by Mr. F~itlow, the following resolution was adopted <br />on final reading by the following vo~e: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A ]ROUP HOUSING PROJECT PURSUANT TO ~¢-55 <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING KNOWN <br />AS "ELMS WAY CONDOMINIUMS" AND DESIGNATED AS GHP-85-55. <br /> <br /> WHEREAS, Metro Development Corporation, has made application pursuant to ~40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a group hous- <br />ing project consisting of twenty-eight (28) units in seven (71 buildings on a 1.19 acre parcel <br />on Elmhurst Lane, approximately 150' north of its intersection with Airline Boulevard; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of ~40-55; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted <br />therewith and has recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan' <br />to ~0~SS grants only an exemption from certain requirements for residences'as stated in said <br />section and does not constitute a waiver of any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicable <br />local, state, or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permats or any other required permit will b, <br />issued only upon complicance with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain group housing project described above shall be revised so as to consist of twenty-I <br />four (24) units in six (6) buildings on a 1.19 acre parcel on Elmhurst Lane approximately 150' <br />north of its intersection with Airline Boulevard and designated a5 GHP-85-35 and more specifi- <br />cally described in correspondence from Metro Development Corporation dated January 27, 1986, <br />with enclosures, and such other correspondence not inconsistent with this approvad previously <br />provided by the applicant and on file with the appropriate officials of the City of Portsmouth <br />Virginia, all of the above being made a part hereof is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> 1. A standard site improvement plan must be submitted to the Department of Engineering <br />and Technical Services for rev%ew and approval and specify that internal drainage and utility <br />easements are to be private rather than public easements and that existing vegetation be <br />preserved wherever practical. <br /> <br /> <br />
