february 25, 1986 <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE NEW fESTAMENT CHURCH TO OPERATE A <br />CHURCH AND PLACE OE WORSHIP AT 405 RAPIDAN STREET. <br /> <br /> WHEREAS, the New Testament Church, by Deacon Tommie L. Pope, Sr., has made application <br />pursuant to 640-70 (bl of the Code of the City of Pcrtsmouth, Virginia, 1973, for the grantin <br />of a use yermit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commissmon has recommended the granting of a use permit for the <br />operation of a church and place of worship, including educational buildings. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property and <br />improvements ~n the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. The New Testament Church is hereby granted a use ~ermit pursuant to ~40-70 (bi of <br />the Code of the City of Portsmouth to operate a church and place of worship, including educa- <br />tional buildings, on the property designated as 403 Rapidan Street and described as Tax Map <br />532, Parcels 57.1 and 58 (UP-86-1] , such property being more particularly described as follow~ <br /> <br />UP-86-1 <br /> <br /> BEGINNING at the northeast intersection o~ Rapidan Street and Greenwcod Drive: <br />thence north along the east right-oE-way of Rapidan Street 334.18'; thence east <br />150'; thence south 98.75'; thence west 50'; thence south 235.43' to the north <br />right-of-way of Greenwood Drive: thence west 100' along said right-of-way to Rapidan <br />Street, ~he Point of Beginning. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a) A standard landscaping plan must be submitted to <br />for review and approval. <br /> <br /> (b) the New Testament Church must obtain a waiver of <br />from the Board of Zoning Appeals." <br /> <br />the Planning Department <br />the rear yard requirement <br /> <br />86-28 - Group housing application: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />640-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br />CONSITING OF A 4-UNIT APARTMENT BUILDING AT 207 GILMERTON AVENUE AND <br />DESIGNATED AS GHP-85-36. <br /> <br /> WHEREAS, Albert Whitley, has made app]ication pursuant to 640-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing project <br />consisting of a four-unit apartment building at 207 Gilmerton Avenue (Tax Plate 71, Parcel <br />66), which consists of approximately 10,000 square feet of property; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission <br />requirements of ~40-551 and <br /> <br /> WHEREAS, the <br />therewith and has <br />cation; and <br /> <br />Planning Commission has reviewed such application and site <br />made a recommendation consi~hg of a conditional approval of <br /> <br />to have met the <br /> <br />plan submitted <br />said appli- <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursua~ <br />to §40-55 grants only an exemption from certain requirements for residences as stated in said <br />section and does not constitute a waiver of any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicabl~ <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is award that building permits or any other required permit will <br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that <br />the certain group housing project consmsting of a 4-unit apartment building at 207 Gilmerton <br />Avenue and designated as GHP-85-36 is hereby granted approval subject to the following terms <br />and conditions: <br /> <br /> (a) The site plan to be made a part hereof is to be reviewed so as to have <br />parking in the rear and the building setback equal to the average setback of abutting proper- <br />ties, such revised site plan ~o be submitted ~o the Engineering and Technical Services Depart- <br />men~ of the City for review and approval, and same must include a sidewalk along Gilmerton <br /> <br /> <br />
