November 22, 2022 Discussion:  City Council Ordinance 2021-31 states “all unspent appropriations under this ordinance or any ordinance appropriating funds for the FY 2022 Portsmouth Public Schools budgets shall lapse at the end of the fiscal year, as provided under 22.1-100 of the Code of Virginia. Funds encumbered but unpaid by the end of the fiscal year will be deemed unspent appropriations that will require re-appropriations by the City Council.”  Re-appropriation Request of Unspent/Carryforward Funds: PPS is requesting the re-appropriation of the preliminary amount of $3,128,184 related to unspent funds as of the end of the fiscal year. The unspent funds would be used for the following: $327,904 for the Workers’ Compensation/General Liability Program o $2,800,280 for the PPS Health Plan o  The following table shows the impact of the proposed re-appropriation of the preliminary amount to the FY 2023 PPS Risk Management Fund: Current Total Revised FY 2023 FY 2022 Re-FY 2023 Fund Appropriation appropriation Appropriation $23,200,000 Risk Management Fund $3,128,184 $26,328,184 Financial Impact:  This is a re-allocation of previously appropriated FY 2022 PPS Risk Management Fund money.  The FY 2023 PPS Risk Management Fund will increase by the amount shown above. Staff Recommends:  Adoption of the ordinance. Next Steps Following Council Action:  The Finance Departments for the City and Schools will complete the necessary budget adjustments. Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following ordinance, and was adopted by the following vote: “ORDINANCE TO RE-APPROPRIATE UNEXPENDED FUNDS IN THE AMOUNT OF $3,128,184 FROM THE FY 2022 PORTSMOUTH PUBLIC SCHOOLS RISK MANAGEMENT FUND BUDGET TO THE FY 2023 PORTSMOUTH PUBLIC SCHOOLS RISK MANAGEMENT FUND BUDGET.” Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None 22 - 352 - Adoption of a resolution authorizing the City Manager to accept the terms of drinking water construction fund financing from the Virginia Department of Health, including forgiveness of the entire principal amount of $150,000. Background:  Lead and Copper Rule Revisions adopted by EPA require public water supply owners to develop and implement a Lead Service Line replacement program. This is a federal mandate.  Development of a Lead Service Line Replacement Action Plan is the initial step in developing the program. This task is on-going and is being completed by one of the City’s professional engineering annual service firms, Hazen and Sawyer. City Council will be fully briefed prior to finalizing and implementing the Action Plan.  In May 2022 the City applied to the Virginia Department of Health (VDH) for a low interest loan to fund preparation of the Action Plan.
