November 22, 2022 <br /> <br /> <br /> VDH has now advised the City that it intends to convert the financing the City <br /> <br />applied for from a repayable loan to a grant through principal forgiveness. <br /> <br />Discussion: <br /> <br /> In order to take advantage of VDH’s principal forgiveness, the City Manager must <br />advise VDH that the City accepts its terms by December 16, 2022. <br /> <br /> The purpose the Resolution presented for Council consideration is to authorize the <br />City Manager to accept the terms of the VDH financing, including the principal <br />forgiveness. <br /> <br />Financial Impact: <br /> <br /> Since it is being converted to a grant, the City will not have to repay the VDH <br />financing. <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> The City Manager will notify VDH that it accepts the financing terms. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT THE TERMS OF <br />DRINKING WATER CONSTRUCTION FUND FINANCING FROM THE VIRGINIA <br />DEPARTMENT OF HEALTH, INCLUDING FORGIVENESS OF THE ENTIRE <br />PRINCIPAL AMOUNT OF $150,000. <br /> <br /> WHEREAS, <br />Lead and Copper Rule Revisions adopted by EPA require public <br />water supply owners to develop and implement a Lead Service Line Replacement <br />Program; and <br /> <br />WHEREAS, <br /> the City applied for low interest loan financing in the amount of <br />$150,000 from the Virginia Department of Health (VDH) to prepare an Action Plan for the <br />Program; and <br /> <br />WHEREAS, <br /> VDH has notified the City that it is willing to forgive the entire principal <br />amount of the financing, thereby converting the loan to a grant; and <br /> <br />WHEREAS, <br /> the City is required to notify VDH that it accepts the financing terms, <br />including the principal forgiveness, by no later than December 16, 2022; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it accepts the proposed terms of the Virginia Drinking Water Construction <br />Fund financing proposed by the Virginia Department of Health; and <br /> <br />BE IT FURTHER RESOLVED <br /> that the City Manager is authorized to so notify the <br />Department of Health and to take such further actions and execute such documents as <br /> <br />are necessary or desirable to obtain and confirm the financing.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />22 - 353 - Adoption of resolutions approving the 2023 State Legislative Initiatives <br />Package and the 2023 Federal Legislative Initiatives Package. <br /> <br />Background: <br /> <br /> Every Department within the City was provided an opportunity to identify issues for <br /> <br />inclusion in the 2023 State and Federal Legislative Initiatives Packages. <br /> <br /> All submissions were included in the draft Power-Point presentation presented to <br /> <br />City Council at its Public Work Session on Tuesday, October 11, 2022. <br /> <br /> <br /> <br /> <br />
