November 22, 2022  VDH has now advised the City that it intends to convert the financing the City applied for from a repayable loan to a grant through principal forgiveness. Discussion:  In order to take advantage of VDH’s principal forgiveness, the City Manager must advise VDH that the City accepts its terms by December 16, 2022.  The purpose the Resolution presented for Council consideration is to authorize the City Manager to accept the terms of the VDH financing, including the principal forgiveness. Financial Impact:  Since it is being converted to a grant, the City will not have to repay the VDH financing. Recommended Action:  Adoption of the resolution. Next Steps Following Council Action:  The City Manager will notify VDH that it accepts the financing terms. Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT THE TERMS OF DRINKING WATER CONSTRUCTION FUND FINANCING FROM THE VIRGINIA DEPARTMENT OF HEALTH, INCLUDING FORGIVENESS OF THE ENTIRE PRINCIPAL AMOUNT OF $150,000. WHEREAS, Lead and Copper Rule Revisions adopted by EPA require public water supply owners to develop and implement a Lead Service Line Replacement Program; and WHEREAS, the City applied for low interest loan financing in the amount of $150,000 from the Virginia Department of Health (VDH) to prepare an Action Plan for the Program; and WHEREAS, VDH has notified the City that it is willing to forgive the entire principal amount of the financing, thereby converting the loan to a grant; and WHEREAS, the City is required to notify VDH that it accepts the financing terms, including the principal forgiveness, by no later than December 16, 2022; NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it accepts the proposed terms of the Virginia Drinking Water Construction Fund financing proposed by the Virginia Department of Health; and BE IT FURTHER RESOLVED that the City Manager is authorized to so notify the Department of Health and to take such further actions and execute such documents as are necessary or desirable to obtain and confirm the financing.” Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover Nays: None 22 - 353 - Adoption of resolutions approving the 2023 State Legislative Initiatives Package and the 2023 Federal Legislative Initiatives Package. Background:  Every Department within the City was provided an opportunity to identify issues for inclusion in the 2023 State and Federal Legislative Initiatives Packages.  All submissions were included in the draft Power-Point presentation presented to City Council at its Public Work Session on Tuesday, October 11, 2022.
