October 26, 2021 <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE ACCEPTING LOCAL EMERGENCY MANAGEMENT PROGRAM <br />GRANT FUNDS IN THE AMOUNT OF $57,992 FROM THE VIRGINIA DEPARTMENT <br />OF EMERGENCY MANAGEMENT AND APPROPRIATING SAID AMOUNT IN THE FY <br />2022 GRANTS FUND FOR USE BY THE DEPARTMENT OF FIRE, RESCUE AND <br />EMERGENCY SERVICES.” <br /> <br />Ayes: Barnes, Battle, Lucas-Burke, Moody, Whitaker, Woodard, Glover <br />Nays: None <br /> <br />21 - 324 - Adoption of a resolution authorizing the grant of easements to the <br />Hampton Roads Sanitation District encumbering property located in Suffolk. <br /> <br />Background: <br /> <br /> Hampton Roads Sanitation District is working with the City of Suffolk on a sewer <br />pump station replacement project and has requested easements from the City of <br />Portsmouth in connection with the project. <br /> <br /> The property to be subjected to the easements is located in Suffolk and is owned <br />by Portsmouth for use in connection with its lakes and water facilities. <br /> <br /> The grant of the easements will not have any negative impact on Portsmouth’s <br />water operations. <br /> <br />Discussion: <br /> <br /> The City of Portsmouth, the City of Suffolk, and HRSD have traditionally worked <br />cooperatively in granting each other (and the utility companies working with each) the <br />land rights necessary for efficient operation of their respective water and sewer facilities. <br /> <br /> HRSD has agreed to pay a purchase price of $21,611 for the easements. <br /> <br />Financial Impact: <br /> <br /> <br /> There is no financial impact other than receipt of the purchase price. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver any required documents to create the <br />easements. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Woodard, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE GRANT OF EASEMENTS TO THE HAMPTON <br />ROADS SANITATION DISTRICT ENCUMBERING PROPERTY LOCATED IN <br />SUFFOLK. <br /> <br /> WHEREAS, <br />the Hampton Roads Sanitation District has requested easements (the <br />“Easements”) across certain properties owned by the City of Portsmouth and located in <br />Suffolk, the said properties having Suffolk Tax Parcel designations of 35D*X8 and <br />35D*XX; and <br /> <br />WHEREAS, <br /> the Easements are more particularly shown and described on that <br />certain “Plat Showing 30’ Permanent HRSD Utility Easement” and that certain “Plat <br />Showing 30’ Permanent Utility Easement, Proposed 20’ Permanent Ingress/Egress <br />Easement, and Proposed Temporary Construction Easement”, each prepared by Rouse- <br />Sirine Associates, Ltd., dated November 10, 2020, and attached hereto as Exhibits A-1 <br />and A-2 (the “Plats”); and <br /> <br />WHEREAS, <br /> the Easements are in furtherance of the replacement of a pump <br />station for the City of Suffolk; <br /> <br /> <br /> <br /> <br />
