April 22, 1986 in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit xs sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or znjurious to the property or improw ments in the neighborhood; and (c) Will be in accordance with the purposes of the zoning chapter of the City Code. 2. The use permit is approved subject to the following conditions: (a) A landscaping Flat, including screening on the Portsmouth Boulevard frontage, must be submitted to the Planning Department for their review and approval. (b) The applicant shall comply with all applicable codes, ordinances, policies and regulations of federal, state and local governments, and shall obtain all necessary licenses and permits. 4. This resolution shall take effect from the date of its adoption." Ayes: Beamer, Gray, Lucas, Webb, Whit'low, Holley Nays: Corprew 86-103 %he following crdinance approved on first reading at the regular meeting of April' 8, 1986, was taken up and read: "AN ORDINANCE TO APPROPRIATE $200,000 FROM THE CAPITAL rMPROVEMENT FUND FOR THE COMMERCIAL FACADE LOAN PROGRAM.'
