Baliles, on April 3, 1986, signed House Bills 382 and 399 allowing <br />for the incorporation of "The Sports Authority of Hampton ROads, Virginia". <br /> <br /> With this action by the Governor, the City can proceed with adopting a resolution to <br />create the Sports Authority and the required Articles of Incorporation. According to Brad Fac~ <br />his organization is submitting similar requests to all member communities in Hampton Roads. <br /> <br /> Your attorney, Steven Lieberman, has reviewed the documents, and I join the Future of <br />Hampton Roads, Incorporated in requesting your favorable consideration." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Corprew, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION CREATING THE SPORTS AUTHORITY OF H~4PTON ROADS, VIRGINIA BY THE JOINT <br />ACTION OF THE COUNCILS OF THE CITIES OF HAMPTON, NEWPORT NEWS, PORTSMOUTH, NORFOLK, <br />VIRGINIA BEACH, CHESAPEAKE, AND SUFFOLK, VIRGINIA, AND THE BOARD OF SUPERVISORS OF <br />ISLE OF WIGHT COUNTY, VIRGINIA, AS PROVIDED IN CHAPTER 29, TITLE 15.1 OF THE CODE <br />OF VIRGINIA OF 1950, AS AMENDED. ~ <br /> <br /> WHEREAS, the Public Recreational Facilities Authorities Act, Chapter 29, Title 15.1 of <br />the Code of Virginia of 1950, as amended (Section 15.1-1271, et~ seq.) ( the Act) authorizes <br />the governing bodies of politizal subdivisions of the Commonwealth--6-{ Virginia, by concurrent <br />resolutions or ordinances, to create an authority with such public and corporate powers as set <br />forth therein; and <br /> <br /> WHEREAS, the Councils of the Cities of Hampton, Newport News, Portsmouth, Norfolk, Virgin~ <br />Beach, Chesapeake, and Suffolk and the Board of Supervisors of the County of Isle of Wight haw <br />agreed to create jointly The Sports Authority of Hampton Roads, Virginia with such public and <br />and corporate powers as set forth in the Act: and <br /> <br /> WHEREAS, a public hearing has been hel~ with <br />pursuant to the public notzce given ~n accordance <br />of the Code of Virginia of 1950, as amended. <br /> <br />respect to the creation of such authority <br />with the requirements of Section 15.1-1273 <br /> <br /> NOW, ~BREEORE~[-BE IT RESOL~ED~by. Zhe Council .of the~'Ci~y ofa'Porfsmonth, Vimginia: <br /> <br /> 1. That it does hereby create, concurrently with the Cities of Newport News, Hampton, <br />Norfolk, Virginia Beach, Chesapeake, and Suffolk and the County of Isle of Wight, The Sports <br />Authority of Hampton Roads, Virginia (the Authority) having as its articles of incorporation <br />those Articles of Incorporation set forth in Exhibit A attached hereto and by this reference <br />made a part hereof and with such powers, duties and other matters pertaining thereto as set <br />forth in the Act. , <br /> <br /> 2. That this Resolution will be effective provided the Councils of the Cities of Newport <br />News, Hampton, Norfolk, Virginia Beach, Chesapeake, and Suffolk and the Board of Supervisors <br />of the County of Isle of Wight adopt similar resolutions or ordinances creating the Authority. <br /> <br /> 3. The Commission of the Authority shall consist of eight (8) members (Commissioners), <br />the governing body of eac~ of the ~nztal participating political subdivisions appointing one <br />such Commissioner. The initial eight (8) Commissioners shall be appointed for a term beginnin <br />with the date of appointmen~ and ending four [4) years subsequent to the first day of the <br />Calendar month next succeeding the date of the initial appointment to the Authority; subsequen <br />appointments shall be for terms of four years, except appointments to fill vacancies which sha] <br />be for ~he unexpired terms. If at the end of any term of office of any Commissioner a success, <br />thereto shall not have been appointed, then the Commissioner whose term of office shall have <br />expired shall continue to hold office until his successor shall be appointed and qualified. <br /> <br /> 4. The City of Portsmoutk shall not be liable for any debt, contract, or other financial <br />commitment of the Authority unless and until such debt, contract, or financial commitment shal[ <br />have been duly authorized by the Council of the City of Portsmouth. <br /> <br /> S. the Council of the City of Portsmouth hereby appoints Morton V. Whitlow as the Commis~ <br />sioner from Portsmouth, Virginia." <br /> <br />"EXHIBIT A <br /> <br /> ARTICLES OF INCORPORATION <br /> OF <br /> THE SPDRTS AUTHORITY OF HAMPTON ROADS, VIRGINIA <br /> <br />to the provisions of Chapter 29, Title 1S.1, Code of Virginia of 1950, as amendec <br />Hampton, Newport News, Portsmouth, Norfolk, Virginia Beach, Chesapeake, and Suf- <br /> hereby £'ointly create a political subdivision of the <br /> end set forth the following: <br /> <br />the Cities of <br />folk, and the County of Isle of Wight, <br />Commonwealth of Virginia, and to that <br /> <br /> 1. The name of the authority is THE SPORTS AUTHORITY OF H~MPTON ROADS, VIRGINIA and the <br />address of its principal office is 16 Koger Executive Center, Norfolk, VA. 23502. <br /> <br /> 2. The Sports Authority of Hampton Roads, Virginia is created under Chapter 29, Title <br />15.1 of the Code of Virginia of 1950, as amended. <br /> <br /> <br />
