February 25, 2020 <br /> <br />Ayes: Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />20 - 60 - Adoption of an ordinance to amend and reordain article I of Chapter 6 of <br />the Code of the City of Portsmouth, Virginia (2006) regarding the regulation of <br />vessels in the North Harbor and High Street Inlet and along the Portsmouth Seawall <br />by amending Section 6-7 to clarify that the mooring of certain vessels used for the <br />operation of a public ferry service is permitted. Tabled from the February 11, 2020 <br />City Council Meeting. <br /> <br />Background: <br /> <br /> In 2015, Section 6-7 of the City Code was amended to add several rules and <br />regulations regarding the mooring of vessels in the North Harbor and the High Street Inlet, <br />and along the Portsmouth Seawall. <br /> <br /> The amended Code language has been effective in protecting the inlets and <br />seawall from damage, but the language could be read as applying not just to recreational <br /> <br />vehicles but also to the HRT ferries. <br /> <br /> It was not the intent of the 2015 amendment to prevent HRT from mooring its <br /> <br />ferries at the docks HRT operates at the North Landing and High Street Inlet. <br /> <br />Discussion: <br /> <br /> The draft Code amendment presented for Council consideration exempts public <br />ferries from regulations regarding limitations on the total amount of time a vessel is <br />moored during a 30-day period, the reservation of spaces for mooring, and the maximum <br />permitted length of moored vessels. <br /> <br />Financial Impact: <br /> <br /> None <br /> <br />Recommended Action: <br /> <br /> Adoption of the Ordinance. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> The City Code will be implemented as amended. <br /> <br />Motion by Mr. Clark, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO AMEND AND REORDAIN ARTICLE I OF CHAPTER 6 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) REGARDING THE <br />REGULATION OF VESSELS IN THE NORTH HARBOR AND HIGH STREET INLET <br />AND ALONG THE PORTSMOUTH SEAWALL BY AMENDING SECTION 6-7 TO <br />CLARIFY THAT THE MOORING OF CERTAIN VESSELS USED FOR THE <br />OPERATION OF A PUBLIC FERRY SERVICE IS PERMITTED.” <br /> <br />Ayes: Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />- City Manager’s Report - <br /> <br />20 - 79 - Adoption of an ordinance accepting a grant in the amount of $727,691.94 <br />from the U.S. Department of Agriculture Child and Adult Care Food Program <br />administered through the Virginia Department of Education and appropriating said <br />funds in the FY 2020 Grants Fund for use by the Department of Parks, Recreation <br />and Tourism to provide meals and snacks authorized under the Kids Meals <br />Program. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
