February 25, 2020 <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Elaine Harris is hereby granted a use permit pursuant to Section 40.1- <br />2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to convert an existing single <br />family detached dwelling to a duplex at 1038 Crawford Parkway, Tax Parcel 0036-1200, <br />being more particularly described as: <br /> <br />UP-19-17 <br /> <br /> <br />1038 Crawford Parkway <br />(Tax Parcel 0036-1200) <br /> <br /> ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, known, numbered and designated as 1038 Crawford Parkway (formerly A <br />Street), situate, lying and being in that part of the City of Portsmouth, Virginia known as <br />Park View, and bounded as follows: Beginning on the North side of Crawford Parkway <br />(formerly A Street), 262 feet 6 inches West from the Northwest intersection of Hatton <br />Street and Crawford Parkway (formerly A Street); thence running West on Crawford <br />Parkway (formerly A Street), 30 feet; thence North and parallel with Hatton Street 110 <br />feet; thence East and parallel with Crawford Parkway (formerly A Street), 30 feet; thence <br />South and parallel with Hatton Street 110 feet to the point of beginning. <br /> <br />IT BEING all that certain property conveyed to Elaine F. Harris by Deed of Gift from <br />William D. Harris dated April 5, 2018 and recorded in the Portsmouth Circuit Court Clerk’s <br />Office as Instrument Number 180003588. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Without limitation, plans shall be submitted for review and approval by the City <br />Building Official prior to permit issuance and construction of the development. <br /> <br />(b) The number of dwelling units on the property shall not exceed two (2) units. <br /> <br />(c) All unsightly damage to the structure on the property that can be viewed from the <br />street shall be repaired in compliance with a Certificate of Appropriateness obtained from <br />the Historic Preservation Commission. <br /> <br />(d) The development shall be constructed, maintained and operated in compliance <br />with all applicable codes, ordinances and regulations of federal, state and local <br />government, including without limitation the Virginia Uniform Statewide Building Code. <br /> <br />(e) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the conditions set forth <br />” <br />herein may serve as grounds for revocation of the use permit by City Council. <br /> <br />Ayes: Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br /> Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to remove Item 20-60 <br />from the table, and was adopted by the following vote: <br /> <br /> <br /> <br /> <br />
