February 25, 2020 (e) Avoids significant deterioration of water and air resources, and other natural resources; (f) Maintains safe and adequate egress and ingress onto the site, and safe road conditions around the site; (g) Allows for the protection of property values and the ability of neighboring lands to develop the uses permitted in the zoning districts; and (h) Complies with all other city, state, and federal laws and regulations. 2. That Elaine Harris is hereby granted a use permit pursuant to Section 40.1- 2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to convert an existing single family detached dwelling to a duplex at 1038 Crawford Parkway, Tax Parcel 0036-1200, being more particularly described as: UP-19-17 1038 Crawford Parkway (Tax Parcel 0036-1200) ALL THAT certain lot, piece or parcel of land, with the buildings and improvements thereon, known, numbered and designated as 1038 Crawford Parkway (formerly A Street), situate, lying and being in that part of the City of Portsmouth, Virginia known as Park View, and bounded as follows: Beginning on the North side of Crawford Parkway (formerly A Street), 262 feet 6 inches West from the Northwest intersection of Hatton Street and Crawford Parkway (formerly A Street); thence running West on Crawford Parkway (formerly A Street), 30 feet; thence North and parallel with Hatton Street 110 feet; thence East and parallel with Crawford Parkway (formerly A Street), 30 feet; thence South and parallel with Hatton Street 110 feet to the point of beginning. IT BEING all that certain property conveyed to Elaine F. Harris by Deed of Gift from William D. Harris dated April 5, 2018 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number 180003588. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Without limitation, plans shall be submitted for review and approval by the City Building Official prior to permit issuance and construction of the development. (b) The number of dwelling units on the property shall not exceed two (2) units. (c) All unsightly damage to the structure on the property that can be viewed from the street shall be repaired in compliance with a Certificate of Appropriateness obtained from the Historic Preservation Commission. (d) The development shall be constructed, maintained and operated in compliance with all applicable codes, ordinances and regulations of federal, state and local government, including without limitation the Virginia Uniform Statewide Building Code. (e) All taxes/fees associated with the property and/or the proposed use shall be paid when due, as determined by the City Treasurer. REVOCATION OF PERMIT: 4. Violation of any of the conditions set forth ” herein may serve as grounds for revocation of the use permit by City Council.
