<br /> 86-202 Letter from the City Manager recommending adoption of a resolution to authorize
<br />the City Manager to enter into an amendment to the agreement with Hampton Roads Sanitation
<br />District dated March 26, 1986, for the sale of certain City sanitary sewage facilities.
<br />
<br /> "On September 10, 1985, yon authorized me to execute an agreement with the Executive
<br />Director of the Hampton Roads Sanitation District (HRSD) for the sale of our system to that
<br />agency. A minor modification has been recommended by the Executive Director, and the City
<br />Attorney and I fe~l that it does not negate the benefits we will receive from this purchase
<br />as mentioned in my previous letter (attached).

<br /> Therefore, it ms recommendedthat City Council authorize me to sign the modified agree-
<br />ment and allow us to proceed to file a petition in Cirucit Court for the remaining portion of
<br />the City of Portsmouth to join the Hampton Roads Sanitation District effective July, 1988."

<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AMENDMENT TO THE
<br />AGREEMENT WITH HAMPTON ROADS SANITATION DISTRICT DATED MARCH 26, 1986 FOR THE
<br />SALE OF CERTAIN CITY SANITARY SEWAGE FACILITIES.
<br />
<br /> WHEREAS, pursuant to a resolution adopted by the Portsmouth City Council September 10,
<br />1985, the City Manager entered into an agreement with Hampton Roads Sanitation District,
<br />dated March 26, 1986, for the sale of the Pinners Point Sewage Treatment Plant and certain
<br />sewage transmission mains and other sewage facilities; and
<br />
<br /> WHEREAS, said agreement was contingent upon certain financial approvals by the Virginia
<br />State Water Control Board and the United States Environmental Protection Agency; and
<br />
<br /> WHEREAS, Hampton Roads Sanitation District has requested that said agreement be amended
<br />to delete the financial contingencies and approvals; and
<br />
<br />WHEREAS, said amendment is deemed to be in the best interest of the City.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Coun=il of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to enter into an amendment to the agreement
<br />with Hampton Roads Sanitation District dated March 26, 1986, to delete the contingencies
<br />with respect to financial approvals for the sale of certain City sanitary sewage facilities."

<br /> Motion of Mr. Corprew and seconded by Mr. Gray, to reject bids received on 153
<br />Avenue and readertise property requiring a minimum bid of $9,550, and was adopted by
<br />vote.

<br />$8,174.69 (without interest' to Visions Investment, Inc., for tax on alcohol beverage
<br />already included in gross f~od sales.

<br />I recommend that Council adopt this motion, and a refund be granted."

<br /> Motion of Mrs. Webb and seconded by Mr.. Beamer, that authorization be granted to refund
<br />to Visions, 6031 High Street West, Portsmouth, Virginia 23703, $8,174.69 (without interest)
<br />for tax on alcohol beverage sales already included ~n gross food sales, and was adopted by
<br />unanimous vote.

<br /> 86-205 Letter from the City Manager recommending adoption of a motion to refund
<br />$1,492.54 (without interest) to Collins Company, Ltd., for over estimated gross receipts on
<br />their 1985 Business License.
<br />
<br /> "The Commissioner of Revenue is requesting a refund of $1,~92.54 to Collins Co., Ltd.,
<br />416 Boush Street, Norfolk, Virginia 2351).
