June 10~ 1986 <br /> <br />86-169 <br />86-172 <br /> <br />"AN ORDINANCE TO APPROPRIATE $67,161 FROM THE CAPITAL IMPROVEMENT FUND <br />FOR DESIGN OF IMPROVEMENTS TO ~HE BULKHEAD AT THE SOUTH HARBOR." <br /> <br />"AN ORDINANCE TO APPROPRIATE <br />FOR CONVERSION OF UTILITIES <br />DISTRICT." <br /> <br />$360,000 FROM THE CAPITAL IMPROVEMENT FUND <br />IN THE OLDE TOWNE SOUTH UNDERGROUND UTILITY <br /> <br />Ayes: Beamer, Corprew, Gray, Webb, Whitlow, Holley <br />Nays: None <br /> <br />Other Item Removed from the Consent Agenda <br /> <br /> 86-168 The following ordinance approved on first <br />May 27, 1986, was taken up and read: <br /> <br />reading at <br /> <br />the regular meeting of <br /> <br />"AN ORDINANCE TO APPROPRIATE $1,037,716 <br />$549,284 FROM THE PUBLIC UTILITY CAPITAL <br />OF PUBLIS IMPROVEMENTS FOR THE RIVER POINTE <br /> <br />FROM THE CAPITAL IMPROVEMENT FUND AND <br /> IMPROVEMENT FUND FOR THE CONSTRUCTION <br /> <br />PHASE I AND II." <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the matter was deferred <br />meeting of June 24, 1986, and was adopted by unanimous vote. <br /> <br />Other Items Under Unfinished Business <br /> <br />the regular <br /> <br />86-165 - Use permit application: <br /> <br />On <br /> <br />(a) <br /> <br />Resolution granting a use permit to the Autumn Corporation for expansion of <br />~ nursing home at 3610 Winahester Drive, approved on first reading at the <br />regular meeting of May 27, 1986, was taken up and read. <br /> <br /> On motion of Mrs. Webb and-seconded by Mr. Whitlow, the following resolution was adopted <br />final reading,.~nd~s~ adopted By the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO AUTUMN CORPORATION TO OPERATE A NURSING <br />HOME AT 3610 WINCHESTER DRIVE. <br /> <br /> WHEREAS, Durwood A. Brown, Director of Operations of the Autumn Corporation, has made <br />application pursuant to 840-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, <br />for the granring of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />the Planning Commissmon <br /> <br />has recommended <br /> <br />conditional <br /> <br />working <br /> <br />WHEREAS, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) <br /> in the <br /> <br />approval of said use permit. <br />Portsmouth, Virginia: <br /> <br />Will not adversely affect the health and safety of persons residing or <br />neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental ~o the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Autumn Corporatmon is hereby granted a use permit pursuant to 840-78 (b) of the City <br />Code to cperate a nursing home a~t 3610 WinChester Drive further described as Tax Map 330, <br />Parcels 29, 31, 33 and 36. <br /> <br /> 3. .Theuse permit is approved subject ro the following conditions: <br /> (a) All applicable state and local licenses must be obtained prior to operation. <br /> <br /> (b) All building, fire and health code requirements must be satisfied prior to <br />operation. <br /> <br /> (c) No more than one hundred eight (108) patients may be cared for at the facility <br />at any one time. <br /> <br /> (d) This use permit is issued ~o Autumn Corporation, 3610 Winchester Drive, and <br />is not transferable to any other person~, entity or location. <br /> <br /> (e) The landscaping plan shall ~e submitted by the operator to the Planning Depart- <br />ment for review and approval and shall include complete landscaping for the entire parcel <br />including screening and resurfacing of the parking area. The applicant shall provide full sit~ <br />plan improvements as required by Chapter 3B of the City Code and a plat meeting the require- <br />ments of a preliminary plat as defined therein shall be submitted for review and approval by <br />the Plannmng Department.
