June 10, 1986 86-196 Rezoning applications: (a) Zoning Petition Z 8e-6 TRUXTUN NEIGHBORHOOD: Rezoning application of Jean M. Davis, owner, by J. T. Davis and Associates, consultant, to rezone a parcel of land at the northwest corner of Frederick Boulevard and Elliott Avenue, from Industrial M-1 to Residential R-60-K Conditional. On motion of Mrs. Webb and seconded by Mr. Gray, Z 86-6 northwest corner of Frederick Boulevard and Elliott Avenue, R-60-K Conditional, the following ordinance was approved on to rezone a parcel of land at thc from Industrial M-1 to Residential first reading, and was adopted by 'ZONING AMENDMENT ORDINANCE Z 86-6" (b) Zoning Petition Z 86-7 WESTHAVEN NEIGHBORHOOD: Rezoning application of Jack B. Wilkinson, owner, for property at 1700 Airline Boulevard, from Residential R-75 to Office Residential 0R-75. On motion of Mr. Gray and seconded by Mr. Whitlow, Z 86-7 to rezone property at 1700 Airline Boulevard, from Residential R-75 to Office Residential 0R-75, the following ordinance was approved on first reading, and was adopted by unanimous vote: "ZONING AMENDMENT ORDINANCE Z 86r7" - UNFINISHED BUSINESS Councilman Gray requested that Item 86-168 be removed from the Consent Agenda. Consent Agenda On motion of Mr. Gray and seconded by Mrs. Webb, the following items approved on first reading at the Public Heariagmf May 27, 1986 and regular meeting of May 27, 1986, were adopted on final reading, and b) the following vote: 86-165 - Use permit application, proposed amendment to the City Code and rezoning application: "A RESOLUTION GRANTING A USE PERMIT TO ROBERT J. EIGN PROPERTIES TO OPERATE A WHOIESALE HEATING, AIR CONDITIONING AND REFRIGERATION PRODUCTS COMPANY AT THE NORTHWEST CORNER OF ELMHURST LANE AND GARWOOD AVENUE. WHEREAS, RoB~t J. Eign.Properties, by Joseph D. Jones, Regional Manager, has made appli- cation pursuant to 940-71 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director in connection with said application; and WHEREAS, the Planning Commissmon has recommended have done a~l things required to be done the granting of said use permit. the City of Pcrtsmouth, virginia: NOW, THEREFORE, BE IT RESOLVED by the Council of 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the nemghborhood of the proposed use; (b) Will not be detrimental to the public use or injnrious to the property or improv me~ts in the nemghborhood; and Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2.
