August 27, 2019 <br /> <br />927 Crawford Street <br />(Tax Parcel 0026-0870) <br /> <br />ALL THAT certain lot of land, with its appurtenances, situate in the City of Portsmouth, <br />Virginia, and bounded and described as follows: BEGINNING at a point on the South side <br />of Crawford Parkway (formerly “A” Street) one hundred and sixty-eight and one-half (168 <br />½) feet East of the Southeast intersection of Hatton and Crawford Parkway, and from <br />thence running East along Crawford Parkway forty-two (42) feet; thence South, parallel <br />with Hatton Street, one hundred sixteen (116) feet; thence West, parallel with Crawford <br />Parkway, forty-two (42) feet; and thence North, parallel with Hatton Street, one hundred <br />sixteen (116) feet to the point of beginning. <br /> <br />IT BEING Parcel I of that certain property conveyed to ABS LINCS VA, Inc. by Special <br />Warranty Deed from Harbor Point Behavioral Health Center, Inc. dated October 24, 2011 <br />and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number <br />110009792. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) All licenses required to operate an adult day care facility shall be obtained and <br />maintained from the Virginia Department of Social Services and any other appropriate <br />licensure organizations. <br /> <br />(b) The occupant loads of the facilities at 230 Fort Lane, 927 Crawford Parkway, and <br />231 Hatton Street, including staff and clients, shall be determined by the Building Official. <br /> <br />(c) The approved use shall not be established at 230 Fort Lane, 927 Crawford <br />Parkway, or 231 Hatton Street, respectively, until a Certificate of Occupancy has been <br />issued for the applicable property. <br />(d) A parking lot to serve the use shall be designed in a manner meeting the <br />requirements of the City Code and all other applicable laws and regulations. <br /> <br />(e) The development and the use shall comply with all applicable codes, ordinances <br />and regulations of federal, state and local government, including, but not limited to, the <br />Virginia Uniform Statewide Building Code. <br /> <br />(f) All taxes/fees associated with the properties and/or the proposed use shall be paid <br />when due, as determined by the City Treasurer. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />19-293(b): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-19-10) TO SUSAN SLATER TO <br />OPERATE A MICRO-BREWERY AT 346 BROAD STREET, TAX PARCEL 0144-0760. <br /> <br /> <br />WHEREAS <br /> , Susan Slater, the contract purchaser or lessee of the subject property, <br />has made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, <br />Virginia (2006) for the granting of a use permit to operate a micro-brewery at 346 Broad <br />Street, Tax Parcel 0144-0760; and <br /> <br />WHEREAS <br /> , Port Norfolk Properties, L.C., the owner of the subject property, has <br /> <br />consented to the filing of the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> <br /> <br /> <br /> <br />
