August 27, 2019 <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in the <br />zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Susan Slater is hereby granted a use permit pursuant to Section 40.1- <br />2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate a micro-brewery <br />at 346 Broad Street, Portsmouth, Virginia, Tax Parcel 0144-0760, being more particularly <br />described as: <br /> <br />UP-19-10 <br /> <br />346 Broad Street (Tax Parcel 0144-0760) <br /> <br />ALL THOSE certain lots of land, with the buildings and improvements thereon and the <br />appurtenances thereunto belonging, situate in the City of Portsmouth, Virginia, and <br />known, numbered and designated as Lots Six Hundred Eighty-seven (687), Six Hundred <br />Eighty-eight (688) and the adjoining one-half of Lot Six Hundred Eighty-nine (689) as <br />shown on the Map of Port Norfolk, which said plat is duly recorded in the Clerk’s Office of <br />the Circuit Court of the City of Chesapeake, Virginia, in Map Book 4, pages 70 and 71. <br /> <br />IT BEING the same property which was conveyed to Port Norfolk Properties, L.C. by <br />Deed of Bargain and Sale and Assumption from William C. Creecy, Et Ux dated August <br />29, 1994 and recorded in the Clerk’s Office of the Portsmouth Circuit Court in Deed Book <br />1138 at Page 1440. <br /> <br />4. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed micro-brewery shall be limited to 3,000 square feet in total as shown <br />on the proposed floor plans submitted with the Use Permit application on record in the <br />Department of Planning. <br /> <br />(b) The normal hours of public operation shall be limited to 11 A.M. to 11 P.M. Monday <br />through Thursday, 11 A.M. to Midnight on Friday and Saturday, and 1 P.M. to 10 P.M. on <br />Sunday. <br /> <br />(c) No live, amplified entertainment shall be conducted on the premises, except that <br />solo and duo artists may perform on the inside of the premises. When music is played, <br />all doors to the exterior shall remain closed (i.e. shall not be propped open), particularly <br />the overhead door on the north side of the building. <br /> <br /> <br /> <br /> <br />
