August 27, 2019 (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the zoning district(s) of surrounding lands; (d) Is configured to minimize adverse effects, including the visual impacts of the proposed use on adjacent lands; (e) Avoids significant deterioration of water and air resources, and other natural resources; (f) Maintains safe and adequate egress and ingress onto the site, and safe road conditions around the site; (g) Allows for the protection of property values and the ability of neighboring lands to develop the uses permitted in the zoning districts; and (h) Complies with all other city, state, and federal laws and regulations. 2. That ABS LINCS VA, Inc., d/b/a First Home Care Corporation, is hereby granted a use permit pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate an adult day care center at 231 Hatton Street, 927 Crawford Parkway and 230 Fort Lane, Portsmouth, Virginia, and being more particularly described as: UP-19-09 231 Hatton Street (Tax Parcel 0026-0010) ALL THOSE CERTAIN lots, pieces or parcels of land, with their appurtenances, situate in the City of Portsmouth, Virginia, and bounded and described as follows, to-wit: BEGINNING at the Southeast intersection of Hatton Street and Crawford Parkway (formerly A Street), and from thence running East along the South side of Crawford Parkway 168.5 feet; thence South, parallel with Hatton Street, 116 feet; thence West, parallel with Crawford Parkway, 56 feet; thence North, parallel with Hatton Street, 29 feet; thence West, parallel with Crawford Parkway, 112.5 feet to the East side of Hatton Street; and thence North along the East side of Hatton Street 87 feet to the point of beginning. IT BEING Parcel 1 of that certain property conveyed by Center Psychiatrists, Ltd., the sole partner of Center Properties II, to First Home Care Corporation by Deed dated December 15, 1999 and recorded in the Portsmouth Circuit Court Clerk’s Office in Deed Book 1281 at Page 1468. 230 Fort Lane (Tax Parcel 0026-0830) ALL THAT certain lot of land, situate in the City of Portsmouth, State of Virginia, and bounded and described as follows, to-wit: BEGINNING at the Southwest intersection of Fort Lane and Crawford Street, and from thence running West along the South side of Crawford Street fifty (50) feet; thence South and parallel with Fort Lane, one hundred sixteen (116) feet; thence East and parallel with Crawford Street, fifty (50) feet to Fort Lane; and thence North along the West side of Fort Lane, one hundred sixteen (116) feet to the point of beginning. IT BEING that certain property conveyed to ABS LINCS VA, INC. by Special Warranty Deed from Crawford First Education, Inc. dated October 11, 2011 and recorded in the Portsmouth Circuit Court Clerk’s Office as Instrument Number 110009791.
