<br /> WHEREAS, the Planning Commission has made a recommendation for the granting of a special
<br />exception to the off-street parking requirements.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the special exception to be granted:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />in the neighborhood;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or improw
<br />merits in the neighborhood; and
<br />
<br /> (c) Will be in accord with the purposes and objectives of the Downtown D-1 District
<br />and the Zoning Chapter of the City Code.
<br />
<br /> 2. Hugh C, Davies is hereby granted a special exception to the off-street parking requir~
<br />ments in the Downtown D-1 district as provided for in ~40u121 (b) (ivl for the property locate~
<br />at 2309 High Street by the granting of a waiver of the (4) required on-site parking spaces, su,
<br />special exception being approved subject to the following conditions:

<br /> ~(~) The use of Ihe property shall be limited,to an apartment on the second floor and a
<br />sculptor's studio on the first floor. The variance is granted on the basis of the proposed
<br />use and any change from such use will constitute the expiration of the variance hereby granted
<br />

<br />Owner, by Cedric D. Glover, Contract Owner, for property at the southwest
<br />corner of Portsmouth Boulevard and Chestnut Street, from Residential R-75
<br />to Commercial C-2-K Conditional, approved on first reading at the Public
<br />Hearing of June 24, 1986, was taken up and read.

<br /> V~c~ Mayor Webb presided for Item Z 86-9, as Mayor Holley is one of the principles in
<br />B ~ P Savings Club. _ _ ~ ~

<br /> On motion of Mr. Gray and seconded by Mrs. Lucas, the following ordinance was adopted on
<br />final reading, and by the following vote:

<br /> On motion of Mrs. Webb and seconded by Mrs~ Lucas, The following resolution was adopted
<br />on final reading, and by the following vcte:

<br />"A RESOLUTION APPROVING A REVISION TO A GROUP HOUSING PROJECT APPROVED PURSUANT
<br />TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, JANUARY
<br />8, 1985, SAID PROJECT BEING AN EIGHT UNIT RESIDENTIAL STRUCTURE ENTITLED "GLASGOW
<br />COF~X{ONS" AND DESIGNATED AS GHP-84-20.

<br /> WHEREAS, John S. Joannou has made
<br />of Portsmouth, Virginia, 1973, for the
<br />Project GHP-84-20; and
<br />
<br />application pursuant to ~40-55 of the Code of the City
<br />granting and approval of a revision to Group Housing
<br />
<br /> WHEREAS, the proposed revision provides for a change in ownership form from condominium
<br />tO fee s~mple townhouse; and
<br />
<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, by ~ resolution adopted January
<br />8, 1985 granted approval for an eight (8) unit condominium to be constructed on a parcel of la
<br />consmsting of 20,767 square feet at the intersection of Green Street and Glasgow Street and
<br />more specifically described in plans made a part of the resolution approving Group Housing Pro
<br />ject GHP-84-20 and the applicant has completed the construction of said residential project in
<br />accordance with said plans and now requests a change in ownership form; ~nd
<br />
<br /> WHEREAS, the developer xs aware that approval of the revision requested will merely
<br />authorize the developer to file the necessary applications for subdivision approval ~n accord-
<br />ance with Chapter 33 of the Code of the City of Portsmouth, Virginia, 1973, as amended, and
<br />that this revision and change in the form of ownership would not constitute a waiver of any
<br />other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, or Code of the City
<br />of Portsmouth, Virginia or any other applicable local, state or federal law or regulation.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />the certain group housing project consisting of eight (8) residential units to be known as
<br />Glasgow Common Townhomes is hereby revised to permit a change xn ownership from condominiums
<br />to fee simple nownhouses subject to the following terms and conditions:
