May 28, 2019 <br /> <br /> <br /> The easement is a public utility easement 30’ in width and having a total area of <br />3,030 square feet. <br /> <br /> The property to be subjected to the easement is located in the Holy Neck Borough <br />of Suffolk and is owned by Portsmouth for use in connection with its lakes and water <br />facilities. <br /> <br /> The grant of the easement will not have any negative impact on Portsmouth’s <br />water operations. <br /> <br />Discussion: <br /> <br /> The City of Portsmouth and the City of Suffolk have traditionally worked <br />cooperatively in granting each other the land rights necessary for efficient operation of <br />their respective water and sewer operations. <br /> <br />Financial Impact: <br /> <br /> <br /> There is no financial impact. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> The City Manager will execute and deliver any required easement documents. <br /> <br />Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE GRANT OF A PUBLIC UTILITY EASEMENT TO <br />THE CITY OF SUFFOLK HAVING A WIDTH OF 30 FEET AND A TOTAL AREA OF <br />3,030 SQUARE FEET ACROSS CERTAIN PROPERTY LOCATED IN THE HOLY <br />NECK BOROUGH OF SUFFOLK. <br /> <br /> WHEREAS, <br />the City of Suffolk has requested that the City of Portsmouth grant a <br />public utility easement having a width of 30 feet and a total area of 3,030 square feet <br />across certain property located in the Holy Neck Borough of Suffolk; and <br /> <br />WHEREAS, <br /> the purpose of the easement is to install a gravity sewer main in <br />conjunction with a pump station project being constructed by the City of Suffolk; and <br /> <br />WHEREAS, <br /> the area of the easement is more particularly shown on that certain <br />Plat Showing 30’ Permanent Public Utility Easement to be Dedicated to the City of Suffolk, <br />Virginia prepared by Johnson, Mirmiran & Thompson, dated February 5, 2019, and <br />attached hereto as Exhibit A; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the grant of the requested easement to <br />the City of Suffolk and that the City Manager is hereby authorized to execute such <br />documents or instruments as may be necessary or desirable in furtherance of the intent <br /> <br />of this Resolution.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />19 - 197 - Adoption of a resolution authorizing the grant of utility easements over <br />City-owned property necessary for development of the Churchland Bridge <br />Replacement Project. <br /> <br />Background: <br /> <br /> For several years the City of Portsmouth has been planning and designing the <br />Churchland Bridge Replacement Project to replace the northbound lanes of the bridge. <br /> <br /> In connection with the Project it will be necessary to grant one or more easements <br />for utilities over City-owned property in the vicinity of the bridge. <br /> <br /> <br /> <br /> <br /> <br />
