AVENUE." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> 86-264 Letter to the <br />portion of the right-of-way <br />Street. <br /> <br />City Manager recommending adoption of <br />of Chestnut Street between Portsmouth <br /> <br />an ordinance to close a <br />Boulevard and Argyle <br /> <br /> "Robert K. Turner, Ltd., by attorney Cleaves Manning, has made application to close a <br />portion of the right-of-way of Chestnut Street between Portsmouth Boulevard and Argyle <br />Street. This is the original right-of-way area for Chestnut Street as shown on the plat of <br />Brighton. However, the strest was subsequently relocated to the east leaving the original <br />right-of-way as a "paper street'. <br /> <br /> The viewers report and the Planning Commission both recommend approval of this apF <br /> <br /> Since the City is an adjoining property owner on the east, one half of the area to be <br />closed would belong to the City. Section 15.1-366, Code of Virginia, provides that the City <br />may sell its interest in such closed portion of the street to the abutting property owner. <br />The City Assessor has appraised the property at the rate of twenty three cents per square <br />foot. The applicant has agreed to pay the City ~600.00 for the City's portion of the closed <br />street. <br /> <br /> The applicant indicates that this portion of the closed street along with <br />property will be used for residential development purposes. Davis, by Attorney Donald C. Kilgore, has made application to close a portion <br />of Marshall Avenue. This portion of Marshall Avenue is a platted but unimproved street north <br />of Elliott. Avenue in the vicinity of Truxtun School. Both the viewers report and the Planning <br />Commission Report recommend approval of this application. <br /> <br /> I recommend approval of the ordinance on your agenda tonight to close a portion of <br />Marshall Avenue." <br /> <br /> Donald. These code sections, while aproviding the vasic frame work for enforcement, c <br />be strengthened by specifying certain requirements. <br /> <br /> The City Attorney has drafted the attached ordinance to amend the City Code and I s~ <br />the proposed change. In addition, the proposed ordinance clarifies other sections regarding <br />operation and control of City lots. I, therefore, recommend City Council's approval of the <br />proposed code change." <br /> <br /> <br />
