March 26, 2019 <br /> <br /> <br /> 146 Owens Street (the “Property”) is a small .05 acre parcel located on the Owens <br />Street cul-de-sac in the Park View neighborhood of Portsmouth. <br /> <br /> The City acquired the Property many decades ago and has no current use for the <br />Property. <br /> <br /> The only developed parcel adjacent to the Property is 148 Owens Street, which is <br />owned by Brandon Ecijan. <br /> <br /> Mr. Ecijan has offered to acquire the Property from the City and Mr. Ecijan and City <br />staff have negotiated terms and conditions of a proposed conveyance for Council’s <br />consideration. <br /> <br />Discussion: <br /> <br /> The Property is small, ill-suited for standalone development, and of no practical <br />use to the City. <br /> <br /> The City Assessor has assessed the value of the Property at $590. <br /> <br /> Mr. Ecijan has agreed to pay a purchase price equal to the assessed value. <br /> <br /> Prior to closing, Mr. Ecijan will be required to have a minor subdivision plat <br />prepared at his cost to vacate the lot line between the Property and Mr. Ecijan’s property. <br />At closing, the City will reimburse the actual cost of preparation of the plat in an amount <br />not to exceed the available net sale proceeds. <br /> <br /> By requiring that the lot lines between the Property and Mr. Ecijan’s property be <br />vacated prior to conveyance, the City will ensure that no new house of a size and quality <br />incompatible with the neighborhood can be constructed on the Property. <br /> <br /> Virginia Code § 15.2-1800 authorizes localities to convey real property after <br />holding a public hearing on the proposed conveyance. <br /> <br />Financial Impact: <br /> <br /> <br /> The City will receive $590 less the cost of the subdivision plat, plus additional tax <br />revenues in future years as a result of returning the Property to the tax rolls. <br /> <br />Staff Recommends: <br /> <br /> <br /> Adoption of the Resolution <br /> <br />Next Steps Following Council Action: <br /> <br /> Mr. Ecijan will have a minor subdivision plat prepared and submitted for City <br />approval. <br /> <br /> After the plat is approved, the Office of the City Attorney will prepare a deed of <br />conveyance and the transaction will be completed. <br /> <br />Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION DECLARING A CERTAIN CITY-OWNED PROPERTY HAVING A SIZE <br />OF APPROXIMATELY FIVE HUNDREDTHS OF AN ACRE AND AN ADDRESS OF 146 <br />OWENS STREET (TAX PARCEL 0052-0590) TO BE SUPLUS REAL PROPERTY AND <br />AUTHORIZING THE CONVEYANCE OF SAME TO BRANDON ECIJAN. <br /> <br /> WHEREAS, <br />for many decades the City of Portsmouth has owned certain real <br />property having a size of approximately five hundredths of an acre and an address of 146 <br />Owens Street (Tax Parcel 0052-0590) (the “Property”); and <br /> <br />WHEREAS, <br /> the Property is small and ill-suited for development as a standalone <br />parcel; and <br /> <br />WHEREAS, <br /> the City Assessor has assessed the value of the property at $590; <br />and <br /> <br />WHEREAS, <br /> Brandon Ecijan, the owner of the only adjacent developed property <br />(148 Owens Street), has offered to purchase the Property for its assessed value; and <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
