March 26, 2019 <br /> <br />WHEREAS, <br /> the City of Portsmouth acknowledges that no land disturbance <br />activities may occur within the limits of the proposed access project prior to appropriate <br />notification from the Department of Transportation as a condition of the use of the <br />Economic Development, Airport and Rail Access Fund; and <br /> <br />WHEREAS, <br /> the City of Portsmouth hereby acknowledges that the Virginia <br />Department of Transportation’s Economic Development Access (EDA) Program may <br />provide up to a maximum of $650,000 for a project and requires matching funding, up to <br />$150,000, from the City of Portsmouth for estimated eligible project costs over $500,000, <br />up to $800,000; and <br /> <br /> WHEREAS, <br />the City of Portsmouth hereby guarantees that financing of all <br />ineligible project costs, project costs exceeding the EDA Program project allocation, EDA <br />Program required locality matching funds, if applicable, and all costs not justified by <br />eligible capital outlay will be provided from sources other than those administered by the <br />Virginia Department of Transportation; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the City Council hereby requests that the Commonwealth <br />Transportation Board provide Economic Development Access Program funding to <br />provide adequate road access to the referenced property; <br /> <br /> 2. That the City Council hereby agrees to provide a surety or bond, acceptable <br />to and payable to the Virginia Department of Transportation, in the full amount of the <br />Commonwealth Transportation Board’s allocation less eligible private capital outlay credit <br />as determined by VDOT; this surety shall be exercised by the Department of <br />Transportation in the event that sufficient qualifying capital investment does not occur on <br />qualifying parcels within five years of the Commonwealth Transportation Board’s <br />allocation of funds pursuant to this request; and <br /> <br /> 3. That the City Manager and/or her designee(s) are authorized to act on <br />behalf of the City Council to execute any and all documents necessary to secure funding <br />in the maximum amount eligible under the Economic Development Access Program; and <br /> <br /> 4. That it hereby acknowledges that the new roadway so constructed will be <br />added to and become a part of the road system of the City of Portsmouth pursuant to § <br />33.2-1509, paragraph C, of the Code of Virginia; and <br /> <br /> 5. That the City of Portsmouth will request the new roadway\[s\] so constructed <br />to be added to receive maintenance payments in accordance with the provisions of § <br />33.2-319 of the Code of Virginia, and such request for street additions for assistance <br />payments will be submitted, together with a copy of this Resolution and such maps and <br /> <br />other documents as may be necessary in the manner prescribed by the Department.” <br /> <br />Ayes: Battle, Clark, Glover, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br /> <br />19 - 122 - Adoption of a resolution declaring a certain City-owned property having <br />a size of approximately five hundredths of an acre and an address of 146 Owens <br />Street (Tax Parcel 0052-0590) to be surplus real property and authorizing the <br />conveyance of same to Brandon Ecijan. <br /> <br />Background: <br /> <br /> In discussions with the Boards of Commissioners of the Portsmouth <br />Redevelopment and Housing Authority and the Economic Development Authority, City <br />Council has emphasized the importance of returning publicly owned property to the tax <br />rolls. <br /> <br /> By returning publicly owned property to the tax rolls, the City (1) reduces <br />expenditures for maintenance and (2) increases tax revenues. <br /> <br /> <br /> <br /> <br /> <br />
