August 26, 1986 Staff has discussed thSs project wSth the President of the Port ~orfolk Civic League and he has indicated no opposition to the pro- ject. (See attached letter.) As requested by the Civic Leaigue, Dail's has agreed to install a commercial dumpster on site. Dail's proposal would bring $75,000 $100,000 in investment and two new jobs to the City. The sale would also take lanld which aas long been tax-exempt and vacant, and return it to the tax rolls and to productive use. Consequently, I recommend that Cityl Council authorize sale of this property to Dail's Seafood. Attached for your review is the Development Agreement prepared ~y the City Attorney's office." On motion of Mr. Gray and seconded by Mr. Simpson, the: follow- lng resolution was adopted and by the following vote: "A RESOLUTION ACCEPTING THE OFFER OF DAIL'S SEAFOOD TO! PURCHAS~ CITY PROPERTY: AUTHORIZING THE CITY MANAGER TO ENTER INTO A DEVELOPMENT AGREEMENT FOR THE P~RCHASE ANb DEVELOPMENT OF CITY PROPERTY ON tNDUSTRI&L AVENUE. WHEREAS, the City owns certain hereinafter-described real >roperty, which property is not required for public purposes and is, hereby, declared to be excess property; and WHEREAS, said property has been advertised ment as required by Section 2.09 of the Charter Portsmouth; and for sale and develoF of the City of WHEREAS, Dail's Seafood has submitted a proposal for p~rchase of said property for the su~ of $12,632.00; and to construct a 2,500-3,000 square foot concrete and steel building for the opera- tion of a retail and wholesale seafood business; and WHEREAS, the City Council deems it to be in the best i~terest ~f the City that said property be developed in this manner; and WHEREAS, the City and the developer shall enter into an agree- ~ent pertaining to the specific plans for construction and to insure ~rderly development of the subject property. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the offer of Dail's Seafood to p~rchase the hereinafter-described City property be accepted. Said property >eing more particularly described as follows: Beginning at a point on the east side of Industrial Avenue, said point being 150' south of the southeast inter- section of Industrial Avenue and Wesley Street; thence continuing south along Industrial Avenue 125', more or less, to a point: thence east and parallel with Wesley Street 100', more or less, to the property ncw or form~ erly owned by Elizabeth River Tunnel Distric~ north and parallel with Industrial Avenue 12~ or less, to a point; thence west and parallel Street 100', more or less, to the point of be the such deeds or transaction."
