6 <br /> <br />~ugust 26, 1986 <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />)f a use permit for the operation of a childcare center. <br /> <br /> NOW, THEREFORE, BE I% RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />~ersons residing or working in the neighborhood of the propcsed use: <br /> <br /> (b) Will not be detrimental to the public use or injurious <br /> o the proFerty or improvements in the neighborhood: and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning <br />2hapter of the City Code. <br /> <br /> 2. T. C. Bennett is hereby granted a use permit pursuant to <br /> ion 40-71 (b) of the City Code to operate a childcare center at <br />2705 Chicago Avenue iUP-86-8). <br /> <br /> 3. The use permit is approved subject to the following condi-' <br /> ions: <br /> <br /> (a) The childcare center may be operated with an enrollmen <br /> f not more than thirty-nine (39) children to be cared for at the <br />~acility at any one time. <br /> <br /> (b) A five (5) foot wooden-privacy fence shall be installed <br />ceplacing the chainlink fence to the rear, side and front of the <br />~outheastern portion of the parcel and the 42 inch split rail fence <br />}n the western portion of the site. <br /> <br /> (c) Ail childcare center activities shall be conducted wit~ <br />in the main structure and the fenced-in play area. <br /> <br /> (d) A site plan shall be submitted to the Planning staff <br />showing a minimum of two (2) additional on-site drop-off/pick-up <br />~arking spaces which shall be constructed prior to the commencement <br /> the operation of the facility. <br /> <br /> (e) Ail health, fire and building codes must be met prior <br />to commencement of operation of the facility. <br /> <br /> (f) The applicant shall comply with all applicable codes, <br /> tinances, policies and regulations of federal, state and local <br />overnments and shall obtain all necessary licenses and permits. <br /> <br /> (g) All outdoor play activities shall be conducted within <br />he fenced play area and between the hours of 8:00 a.m~ toi6:0O p.m. <br /> <br /> (h) The facility may be operated between the hours of 6:00 <br />~.m. and 12:00 midnight. <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle' <br />Nays: None <br /> <br />Other Items Under Unfinished Business <br /> <br />86-287 <br />(a) <br /> <br />Rezoning Application: <br /> <br />Z-86-13 <br /> <br />CHURCHLAND NEIGHBORHOOD: Rezoning applicatio~ <br />of Associated Churchland Investors, by H~ L. <br />Churchland Associated, contract purchaser, <br />92 acres on the east side of Twin Pines Road <br />lying between the Twin Pines residential sub- <br />division on the north and the Seaboard Coast <br /> <br /> <br />
