WHEREAS, T. C. Bennett has made application pursuant tcSectlor' ~0-71 (b) of the Code of the City of Portsmouth, Virginia, i1973, ~or the granting of a use permit to operate a childcare centier at ~705 Chicago Avenue; and August 26, 1986 WHEREAS, C. Raeford Eure has made application to the Oouncil of :he City of Portsmouth, Virginia requesting the Council to :vacate it ~pproval of group housing project GHP-85-30; and WHEREAS, C. Raeford Eure has proffered on behalf of thle owners of the property to prepare and submit a subdivision plat foE approva which will limit density on the land to not exceed sixteen i(16) unit per acre and to put Community Association documents to reco~d %indin ~11 of the unit owners for maintenance of the exterior of ail units in order to preserve the quality of the project; and WHEREAS, the Planning Commission has reviewed the request ~acate and has made a recommendation thereon; and WHEREAS, the Council of the City of Portsmouth, Virginia ms of zhe opinion that the vacation of the group housing project Will per- nit the orderly development of the property and the developer is ~ware that building permits or any other required permits will be issued only upon compliance with the ordinances, laws or regulatmon:~ ' ~pplicable thereto and that the vacation hereof does nor constitute ~ waiver of any other requirement embodied in the Subdivision Ordin- ~Bnce, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation.
