<br /> WHEREAS, the City

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia, that the offer of Duraloy Metals DivisiOn of
<br />Consolidated Manufactured Products, Inc. to purchase the h~reinafter
<br />described City property be accepted. Said property being more part~
<br />culary described as follows:

<br /> Beginning at a point on the east side of Lee Avenue
<br />said point being 175' south of the southeast intersect!ion of
<br />Lee Avenue and Wesley Street; thence continuing along !the
<br />east side of Lee Avenue 1S0', more or less, to a point!;
<br />thence east and parallel with ~6sley Street 100' more. or
<br />less, to a point; thence north and parallel with'Lee A~enue
<br />150', more or less, to a point; thence west and paralliel
<br />with WeSley Street 100', more or less, to the point of:
<br />beginning.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and h? hereby
<br />is, authorized to enter into a development agreement pertainine to
<br />the terms of purchase and development of said property and ~o ~ign
<br />such deeds o[ other documents as may be necessary to complete this
<br />transaction.'

<br /> 8~-312 - Letter from the City Manager recommendin~ adoption of
<br />a resolutmon to appoint viewers for the closing of por[ions~of[the
<br />following streets: Summit Avenue, Center Avenue, Wilcox Avenue,
<br />Dewey Street, Cedar Avenue and Olympia Avenue, all within the bound-
<br />aries of the property known as Frederick Military Academy.
<br />
<br /> "At the request of the Frederick Foundation, Inc., and in an
<br />effort to market the property, a request has been made to close cer-
<br />tain streets within the fence of the former Frederick Military
<br />Adademy.
<br />
<br /> The attached resolution appoints viewers in ~ccordance with
<br />~pplicable State Law to view the portion of such streets and to
<br />report to the Planning Commission if any inconvenience would result
<br />in these closings.
<br />
<br /> I recommend adoption of the resolution on your agenda for the
<br />appointment ~f viewers in this matter."

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following
<br />~esolution was adopted, and by the following vote:

<br />"A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF
<br />PORTIONS"OF THE FOLLOWING STREETS: SUMMIT AVENUE,
<br />CENTER AVENUE, WILCOX AVENUE, DEWEY STREET, CEDAR
<br />AVENUE AND OLYMPIA AVENUE, ALL WITHIN THE BOHNDARIES
<br />OF THE PROPERTY KNOWN AS FREDERICK MILITARY JCADEMY.
<br />
<br /> WHEREAS, Frederick Foundation, Inc., has mad~ application to
<br />vacate, closg and discontinue the hereinafter-desCribed portions of
<br />certain streets, and it appearing that notice of applicatio~ and
<br />request for the appointment of viewers has been d~ly advertised as
<br />required by law.
<br />
<br /> NOW, THEREFORE, BE I? RESOLVED by the Council of the C~ty of
<br />Portsmouth, Virginia, that Albert J. Carr, Howard L. Davis, !George
<br />N. Powers, Sr., C. L. Knight and Emmerson Smith be appointed viewers
<br />and that William Choate and James V. McGehee be appointed a~te~nate
<br />~iewers in the event one of the preceding viewers fails to ~rtici-
