September 9, 1986 On motion of Mr. Gray and seconded by Mrs. Lucas, the followin~ resolution was adopted, and by the folIowing vote: "A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORIION OF BAY STREET. WHEREAS, Portsmouth Boating Center, Inc., and Christiam Broad- casting Nework have made application to vacate, close and diiscontim the hereinafter-described portion of Bay Street, and it appparing that notice of application and request for the appointment bf viewer ~as duly advertised as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the C~ty of ?ortsmouth, Virginia, that Charles R. Hudgins, Robert Reed, Ha[risonI 4iller, Moses Gibson and Alber~ J. Carr be appointed viewers and thai Simon P. Arrington and Emmerson Smith be appointed alternat? viewerslI in the even~ one of the preceding viewers fails to participate, saidll viewers to view the hereinafter-described portion of Bay Street and to report to this Council in writing whether in their opinion any, and if any what, inconvenience would result in vacating and closing the following: Bay Street Ail that portion of Bay Street being 50' in width and extending from the western boundary of Armstrong Street in a westerly direction approximately 458', more or less, to the waters of Scott Creek." "In order to comply with State Law, it is necessary to iam~nd ;ecti~n~3-409~l,~of Chapter 25 ~f the City Code by eliminlatin~ ~e om ~n~.w?ra ~sa~meanor" traffic violation and replacingl it ~it] Therefore, the City Att'orney is recommending that the a~tached ~rdinance be adopted, substituting the word "infraction" for: the cord "misdemeanor"."
