September 9, 1986 operate an auto repair and gas station at 1544 H--igh Street, approved on first reading at the Public Hearing of August 26, 1986. was taken up and read. On mot[on of Mrs. Webb and seconded by Mr. Simpson, the follow ing resolution was adopted, and by the follow'lng vote: "A RESOLUTION GRANTING CPERATE AN AUTOMOTIVB A USE PERMIT TO BERNIE WARD TO SERVICE STATION AT I544 HIGH STREET. WHEREAS, Bernie Ward, operator, has made application pursuant to Section 40-121 [a) (i) of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, ~HEREFORE, BE IT RESOLVED b) the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) will not adversely affect the health and safety of ~ersons residing or working in the neighborhood of the proposed use¢ (b) will not be detrimental to the public use or o the property or improvements in the neighborhood; and Cc) will be in accordance with the pruposes of the Zoning Chapter of the City Code. 2. Bernie Ward is hereby granted a use permit pursuant to Section 40-121 (a) (i) of the Code of the City of Portsmouth, 1973, to operate an automotive service station as defined in 40-31 of said Code at 1544 High Street such property being further described as tax map 48, parcel 168. (UP-8-10) This use permit is approved subject to the following conditions The applicant must obtain D,1 approval on any necessary exteric alterations to the property." Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle' Nays: None 86-309 - The following ordinance deferred from the regular g of August 26, 1986, was taken up and read: "AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY ADDING SECTION 4-28 TO CHAPTER 4 THEREOF PERTAINING TO DOGS." On motion of Mr. Simpson and seconded by Mrs. ~Vebb, the ordi, was adopted on final reading, and by the following vote: Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb Nays: Holley 86-293 - Resolution appointing viewers for closing of a portio~ Bay street, deferred from the meeting of August 12, 1986, was :aken up and read;
