October 9, 2018 <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Rowe <br />Nays: None <br />Abstain: Smith (Employee of Dominion Energy Virginia) <br /> <br />18 - 390 - Adoption of a resolution authorizing the conveyance of a 0.239 acre <br />portion of Speights Run Reservoir to the City of Suffolk and related easements to <br />the City of Suffolk, Dominion Virginia Energy, and Verizon Virginia, LLC in <br />furtherance of the widening and improvement of Route 58, and further authorizing <br />the City Manager to execute a sales agreement and all deed(s) and other <br />documents necessary to effectuate the intent of this resolution. <br /> <br />Background: <br /> <br /> The City of Suffolk is preparing to improve and widen Holland Road, Route 58. <br /> <br /> The improvements require the acquisition of title to additional land along the south <br />side of Route 58 as it is currently configured, and easements for construction, <br />maintenance and utilities. <br /> <br />Discussion: <br /> <br /> <br /> The City of Suffolk has presented the City of Portsmouth a proposed Agreement <br />of Sale which provides for the City of Portsmouth to convey to the City of Suffolk .239 <br />acre, or 10,405 square feet in fee simple and permanent easements for maintenance, a <br />temporary easement for construction, and a joint easement to Dominion Energy Virginia <br /> <br />and Verizon Virginia, LLC for utilities. <br /> <br /> One permanent easement is for maintenance of drainage and covers an area <br />0.077 acre, or 3344 square feet. The second permanent easement is for maintenance of <br /> <br />a slope and covers an area of 0.254 acre, or 11,068 square feet. <br /> <br /> A temporary easement is required for construction of the improvements until their <br /> <br />completion and covers an area of 0.058 acre, or 2,530 square feet. <br /> <br /> The improvements require easements outside the right of way of Route 58 and <br />adjacent to it to be conveyed to Dominion Energy Virginia and Verizon Virginia, LLC. <br /> <br />These easements both cover the same area of 0.395 acre, or 17,185 square feet. <br /> <br /> The Agreement of Sale calls for a purchase price for right of way and easements <br />of $10,078.00. The approximate value of the land in Speights Run is $1,443.77 per acre <br />according to the assessment of the Suffolk Assessor, which is based on a value of the <br />land in Speights Run at $500,700 for 346.80 acres. <br /> <br />Financial Impact: <br /> <br /> The proposed sale will have little effect on City finances. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> Notify Suffolk that the City of Portsmouth is prepared and authorized to move <br />forward upon receiving all necessary documents including an Agreement of Sale <br />executed by Suffolk. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE CONVEYANCE OF A 0.239 ACRE PORTION OF <br />SPEIGHTS RUN RESERVOIR TO THE CITY OF SUFFOLK AND RELATED <br />EASEMENTS TO THE CITY OF SUFFOLK, DOMINION ENERGY VIRGINIA AND <br />VERIZON VIRGINIA, LLC IN FURTHERANCE OF THE WIDENING AND <br />IMPROVEMENT OF ROUTE 58, AND FURTHER AUTHORIZING THE CITY MANAGER <br />TO EXECUTE A SALES AGREEMENT AND ALL DEED(S) AND OTHER DOCUMENTS <br />NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION. <br /> <br /> WHEREAS, <br />the City of Suffolk is preparing to widen and improve a portion of <br />Route 58, also known as Holland Road, which abuts Speights Run Reservoir owned by <br />the City of Portsmouth; and <br /> <br /> <br /> <br /> <br />
