<br /> WHEREAS
<br />, the City of Suffolk has requested the City of Portsmouth to enter into
<br />an Agreement of Sale whereby the City of Portsmouth would agree to sell to the City of
<br />Suffolk a 0.239 acre (10,405 square foot) portion of Speights Run Reservoir along with
<br />easements required by said construction and subsequent maintenance; and
<br />
<br /> WHEREAS
<br />, said Agreement of Sale further provides for the City of Portsmouth to
<br />convey a joint easement for utilities necessitated by said project to Dominion Energy
<br />Virginia and Verizon Virginia, LLC; and
<br />
<br /> WHEREAS
<br />, the Agreement calls for the City of Suffolk to pay to the City of
<br />Portsmouth the sum of $10,078 as consideration for the right of way and necessary
<br />easements.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED
<br /> by the Council of the City of Portsmouth,
<br />Virginia, that for a purchase price of $10,078 it hereby authorizes the following
<br />conveyances: (1)
<br />to the City of Suffolk, a 0.239 acre (10,405 square foot) portion of the Speights Run
<br />Reservoir, permanent easements of approximately 0.077 acre (3,344 square feet) and
<br />approximately 0.254 acre (11,068 square feet) for maintenance of drainage and slope,
<br />and a temporary easement for construction of approximately 0.058 acre (2,530 square
<br />feet) to expire with completion of construction; and (2) to Dominion Energy Virginia and
<br />Verizon Virginia, LLC easements for utilities of approximately 0.395 acre (17,185 square
<br />feet); and
<br />
<br /> BE IT FURTHER RESOLVED
<br /> that the City Manager be, and she hereby is,
<br />authorized to execute a Sales Agreement and all necessary deed(s) and other documents
<br />
<br />as may be required to effectuate the intent of this Resolution.”
