October 9, 2018  The improvements require non-exclusive easements outside the right of way of Route 58 and adjacent to it to be conveyed to Dominion Energy Virginia and Verizon Virginia, LLC. This easement area covers an area is 0.190 acre, or 8,297 square feet  The Agreement of Sale calls for a purchase price for right of way and easements of $8,073.00. The approximate value of the land in Speights Run is $1,443.77 per acre according to the assessment of the Suffolk Assessor, which is based on a value of the land in Speights Run at $500,700 for 346.80 acres. Financial Impact:  The proposed sale will have little effect on City finances. Recommended Action:  Adoption of the resolution. Next Steps Following Council Action:  Notify Suffolk that the City of Portsmouth is prepared and authorized to move forward upon receiving all necessary documents including an Agreement of Sale executed by Suffolk. Motion by Ms. Lucas-Burke, and seconded by Mr. Clark, to adopt the following resolution, and was adopted by the following vote: “RESOLUTION AUTHORIZING THE CONVEYANCE OF A 0.204 ACRE PORTION OF THE SPEIGHTS RUN RESERVOIR TO THE CITY OF SUFFOLK AND RELATED EASEMENTS TO THE CITY OF SUFFOLK, DOMINION ENERGY VIRGINIA AND VERIZON VIRGINIA, LLC IN FURTHERANCE OF THE WIDENING AND IMPROVEMENT OF ROUTE 58, AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A SALES AGREEMENT AND ALL DEED(S) AND OTHER DOCUMENTS NECESSARY TO EFFECTUATE THE INTENT OF THIS RESOLUTION. WHEREAS, the City of Suffolk is preparing to widen and improve a portion of Route 58, also known as Holland Road, which abuts Speights Run Reservoir owned by the City of Portsmouth; and WHEREAS , the City of Suffolk has requested the City of Portsmouth to enter into an Agreement of Sale whereby the City of Portsmouth would agree to sell to the City of Suffolk a 0.204 acre (8,900 square foot) portion of Speights Run Reservoir along with easements required by said construction and subsequent maintenance; and WHEREAS , said Agreement of Sale further provides for the City of Portsmouth to convey a joint easement for utilities necessitated by said project to Dominion Energy Virginia and Verizon Virginia, LLC, and WHEREAS , the Agreement calls for the City of Suffolk to pay to the City of Portsmouth the sum of $8,073 as consideration for the right of way and necessary easements. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that for a purchase price of $8,073 it hereby authorizes the following conveyances: (1) to the City of Suffolk, a 0.204 acre (8,900 square foot) portion of the Speights Run Reservoir, permanent easements of approximately 0.193 acre (8,411 square feet) and 0.075 acre (3,263 square feet) for maintenance of drainage and slope, and a temporary easement for construction of 0.059 acre (2,585 square feet) to expire with completion of construction; and (2) to Dominion Energy Virginia and Verizon Virginia, LLC easements for utilities of approximately 0.190 acre (8,297 square feet); and BE IT FURTHER RESOLVED that the City Manager be, and she hereby is, authorized to execute a Sales Agreement and all necessary deed(s) and other documents as may be required to effectuate the intent of this Resolution.”
