July 24, 2018 <br /> <br />WHEREAS, <br /> Nell I. Ewell, Trustee of the Nell I. Ewell Revocable Trust, the owner <br />of the subject property, has consented to the filing of the application; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses <br />permitted in the zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of <br />the proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe <br />road conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring <br />lands to develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That P I Tower Development, LLC, is hereby granted a use permit pursuant <br />to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct <br />and operate a 150 foot monopole telecommunications tower and fenced equipment <br />compound at 2015 Columbia Street, Portsmouth, Virginia, Tax Parcel 0169-0860, being <br />more particularly described as: <br /> <br />UP-18-03 <br /> <br />2015 Columbia Street <br />(Tax Parcel 0169-0860) <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon situate in the City of Portsmouth, Virginia, and more particularly described as <br />follows: <br /> <br />BEGINNING at the southwest intersection of Jamestown Avenue (formerly Fifth Avenue) <br />and Columbia Street; thence running south 2° 8’ 27” west a distance of 31.58 feet to the <br />line of the property of the Seaboard Coast Line Railroad; thence along the line south 68° <br />55’ 40” west, a distance of 188.38 feet to a pin; thence continuing along the line south 64° <br />5’ 45” west a distance of 87.97 feet to a pin; thence north 65° 28’ 31” west a distance of <br />16.81 feet to a pin in the eastern side of Meander Road (formerly the old Western Branch <br />Road); thence along Meander Road north 23° 17’ 30” west a distance of 155.90 feet to <br />the intersection of Meander Road and Columbia Street; thence along Columbia Street, <br />south 87° 51’ 33” east a distance of 333.26 feet to the point of beginning; as shown on a <br />certain plat entitled “Plat Showing Survey of Property Located at 2015 Columbia Street, <br />Portsmouth, Virginia for Robert L. Ewell” dated May 26, 1978, and prepared by E. Stuart <br />Ball & Associates, Ltd., Portsmouth, Virginia. <br /> <br /> <br /> <br /> <br />
