July 24, 2018 <br /> <br />IT BEING “Parcel Five” of that certain property conveyed to Nell I. Ewell, Trustee of the <br />Nell I. Ewell Revocable Trust dated October 3, 2013 by Deed of Gift from Nell I. Ewell <br />dated December 7, 2016 and recorded in the Portsmouth Circuit Court Clerk’s Office as <br />Instrument Number 170000524. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The proposed development shall be in substantial compliance with the <br />plans prepared by B C Architects Engineers with an Engineer’s seal dated April 12, 2018 <br />and submitted by the applicant, except where modifications may be required to comply <br />with the City’s Ordinance requirements. <br /> <br />(b) The height of the monopole communications tower shall not exceed 150 <br />feet in height measured from the ground surface immediately adjacent to the tower. <br /> <br />(c) A Type B bufferyard as set forth in Section 40.1-5.2(E) of the Portsmouth <br />City Code shall be provided around the tower’s equipment compound, except at the gate <br />which must be screened in a manner acceptable to the Director of Planning. In addition, <br />any generator located on site must be equipped with a sound reduction cover to mitigate <br />any noise impacts on nearby residences. <br /> <br />(d) The storage of tires on the property outside of an approved storage yard or <br />a single enclosed trailer shall be prohibited. <br /> <br />(e) The applicant must obtain and keep current any required operating licenses, <br />approvals and permits and shall operate in accordance with all federal, state and local <br />regulations. <br /> <br />(f) All taxes/fees associated with the property and/or the proposed use shall <br />be paid when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe <br />Nays: None <br /> <br />18 - 195 - Rezoning: <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Smith, to take Item 18-195(b) off the <br />table, and was adopted by the following vote: <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe <br />Nays: None <br /> <br /> Motion by Mr. Smith, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />1. Pamela Phillips, 114 Webster Avenue, spoke in opposition to this item. <br /> <br />2. Steve Carroll, 3112 River Edge Road, spoke in opposition to this item. <br /> <br />3.
