<br />At a Regular Meeting of the City Council on Tuesday, July 24, 2018, there were
<br />present:

<br />Mayor John L. Rowe, Jr., *Vice Mayor Elizabeth M. Psimas, William E. Moody, Jr., Ray
<br />A. Smith Sr., Dr. Mark M. Whitaker, Nathan J. Clark, Lisa L. Lucas-Burke, Deputy City
<br />Manager LaVoris A. Pace, City Attorney Solomon H. Ashby, Jr.
<br />
<br />Reverend Peter Grana opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Rowe called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Smith, to approve the minutes of a
<br />Called Meeting of July 9, 2018, of a Called Meeting of July 10, 2018, and of a Regular
<br />Meeting of July 10, 2018, and was adopted by the following vote:

<br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Smith, Whitaker, Rowe

<br />18 - 263 - Code amendment and use permit:

<br /> Motion by Ms. Lucas-Burke, and seconded by Mr. Moody, to adopt the following
<br />ordinance approved on first reading at the July 10, 2018 meeting, and was adopted by
<br />the following vote:
<br />
<br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, voiced his concern with how City Council
<br /> tables items.
<br />
<br />18-263(a):
<br />
<br />“ORDINANCE TO AMEND SUBSECTION 40.1-4.5(F)(8) OF CHAPTER 40.1 OF THE
<br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) FOR THE PURPOSE OF
<br />PERMITTING THE OPERATION OF FOOD TRUCKS IN CONJUNCTION WITH A
<br />MICROBREWERY OR MICRODISTILLERY.”

<br /> Motion by Mr. Clark, and seconded by Ms. Psimas, to adopt the following
<br />resolution approved on first reading at the July 10, 2018 meeting, and was adopted by

<br />“RESOLUTION GRANTING A USE PERMIT (UP-18-03) TO P I TOWER
<br />DEVELOPMENT, LLC, TO CONSTRUCT AND OPERATE A 150 FOOT MONOPOLE
<br />TELECOMMUNICATIONS TOWER AND FENCED EQUIPMENT COMPOUND AT 2015
<br />COLUMBIA STREET, TAX MAP 0169-0860.

<br />WHEREAS,
<br /> Drew Patterson, authorized agent for P I Tower Development, LLC,
<br />the contract lessee of the subject property, has made application pursuant to Section
<br />40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use
<br />permit to construct and operate a 150 foot monopole telecommunications tower and
<br />fenced equipment compound at 2015 Columbia Street, Portsmouth, Virginia, Tax Parcel
<br />0169-0860; and
