May 22, 2018 <br /> <br /> <br /> Atlantic Coast Pipeline assesses the value of the requested easement rights at <br />approximately $2,300; however, Atlantic Coast Pipeline has agreed to pay the City <br />$20,000 for the easements. <br /> <br /> Several other localities in Virginia, including Norfolk, have recently granted Atlantic <br />Coast Pipeline similar easement rights. <br /> <br />Financial Impact: <br /> <br /> <br /> The City will receive $20,000. <br /> <br />Recommended Action: <br /> <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> The City Manager will execute easement agreements in a form approved by the <br /> <br />Department of Public Utilities and the Office of the City Attorney. <br /> <br />Motion by Mr. Clark, and seconded by Ms. Lucas-Burke, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE GRANT OF UTILITY, ACCESS, AND RELATED <br />EASEMENTS TO ATLANTIC COAST PIPELINE, LLC ENCUMBERING CERTAIN <br />PROPERTY OWNED BY THE CITY OF PORTSMOUTH AND LOCATED IN <br />CHESAPEAKE AND SUFFOLK. <br /> <br /> WHEREAS, <br />the City of Portsmouth owns certain property located in Suffolk and <br />described as “Parcel 1” in that certain Deed recorded in the land records of the Suffolk <br />Circuit Court in Deed Book 589 at Page 396 (the “Suffolk Property”); and <br /> <br />WHEREAS, <br /> Atlantic Coast Pipeline, LLC, an affiliate of Dominion Energy, has <br />requested that the City grant an easement across approximately 6,326 square feet of the <br />Suffolk Property for the installation of a natural gas pipeline and related uses, the location <br />of the easement being substantially as shown on that certain Right of Way exhibit <br />attached as Exhibit A hereto (together with temporary construction rights, the “Suffolk <br />Easement”); and <br /> <br />WHEREAS, <br /> the City of Portsmouth owns certain property located in Chesapeake <br />and described in that certain Deed recorded in the land records of the Chesapeake Circuit <br />Court in Deed Book 3683 at Page 841 (the “Chesapeake Property”); and <br /> <br />WHEREAS, <br /> Atlantic Coast Pipeline, LLC has requested that the City grant an <br />easement across a thirty by one hundred twenty-one foot strip of the Chesapeake <br />Property for the installation of a vehicular roadway and related uses, the location of the <br />easement being substantially as shown on that certain Right of Way exhibit attached as <br />Exhibit B hereto (the “Chesapeake Easement”); and <br /> <br />WHEREAS, <br /> Atlantic Coast Pipeline, LLC has offered to pay the sum of $20,000 <br />for 2the requested easements; <br /> <br />NOW THEREFORE BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that the grants of the Suffolk Easement and the Chesapeake Easement for a total <br />price of $20,000 are hereby authorized, and that the City Manager is authorized to <br />execute and deliver agreements and such other documents as may be necessary or <br />desirable to grant the said easements and to confirm the terms thereof.” <br /> <br />Ayes: Clark, Lucas-Burke, Moody, Psimas, Whitaker <br />Nays: None <br />Abstain: Smith (employee of Dominion Energy), Rowe (has stock in Dominion Energy) <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
