October 14, 1986 <br /> <br />September 16, 1986, was taken up and read. <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Lucas, the followin <br />resolution was adopted on final reading, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO NORTHSIDE ASSOCIATES <br />TO OPERATE A GROUP HOME FOR ADULTS AT THE SOUTHWEST CORNER <br />OF FORT LANE AND ENTERPRISE WAY. <br /> <br /> WHEREAS, Larry Goldman on behalf of Northside Associates I has <br />lade application pursuant to ~40-121 (a) amended, for the granting <br />of a use permit as hereinafter-deszribed; and <br /> <br /> WHEREAS, the applicant and the Planning Director~v~ done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />of said use permit with conditions. <br /> <br /> NOW, tHEREFORE, BE IT RESOLVED by the Council of the City of <br />~ortsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the health and safety of persons <br />~esiding or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injuriou~ <br />the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter <br />of the City Code. <br /> <br /> 2. Northside Associates I is hereby granted a use permit pur- <br />suant to Section 40-121 (a) (i) of the Code of the City of Portsmou~ <br /> nia to operate a group home for adults, such facility to consis <br />of a one (1) story building of 23,354 square feet located on a 1.32 <br />acre parcel of property at the southwest corner of Fort Lane and <br />Enterprise Way, such property being more particularly described as <br />follows: <br /> <br />UP-86-11 <br /> <br /> BEGINNING at the southwest corner of Fort Lane and Enter- <br />~rise Way; thence south along the west right-of-way of Fort Lane <br />_S0'+ to a point; thence west 383.43'; thence north 150' to the sou~ <br />right-of-way of Enterprise Way; thence east along said right-of-way <br />383'+ to Fort Lane, the Point of Beginning. <br /> <br /> 3. This use permit is approved subject To the following condi <br />tions: <br /> <br /> (a) The facility shall be limited to a maximum of one <br />(100) residents at any one time. <br /> <br />shall <br /> <br /> (b) A landscaping plan detailing (1) a passmve recreation <br />and (2) plant species and their specific locations on the sit~ <br />be submitted to the Planning Department for regiew and approv~ <br /> <br /> (c] An access easement in form approved by the City <br />Attorney duly executed, acknowledged and recorded in the office of <br />the Clerk of the Circuit Court of the City of Portsmouth shall be <br />obtained providing access to the site through the parcel of propert) <br />lying immediately west of the site. <br /> <br /> (d) The applicant shall comply with all applicable codes, <br />ordinances, policies and regulations of federal, state and local <br />governments." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> <br />
