October 14, 1986 <br /> <br />right-of-way between Frederick Boulevard and Deep Creek Boulevard. <br />Since that time, it has been determined that the appropriate right- <br />of-way to be retained for this street should be 66' in width. The <br />City has made application to close an additional 7' on either side <br />of the present right-of-way in order to conform to the present traf- <br />fic requirements. <br /> <br /> I recommend adoption of the resolution on your agenda tonight <br />to appoint viewers pursuant to this application for closure of addi- <br />tional right-of-way.on Elliott Avenue.' <br /> <br />On motion of Mrs. Webb and seconded by Mr. Simpson, the follow- <br />resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION <br />OF ELLI©TT AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth has made application to vacate <br />~lose and discontinue the hereinafter-described portion of Elliott <br /> and it appearing that Notice of Application and request for <br />appointment of viewers has been duly advertised as required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Waldo Davis, William <br />Choate, James H. Griffin, James L. Linehan be appointed viewers and <br />that George N. Powers, Sr., and Matthew L. Peanort be appointed <br />alternate viewers in the event one of the preceding viewers fails <br />to participate, said viewers to view the hereinafter-described pot- <br /> of such street and to report to this Council in writing whether <br />in their opinion any, and if any what, inconvenience would result in <br />ziewing and closing the following: <br /> <br />Elliott Avenue <br /> <br /> All those two certain strips of land, being the <br />northern and southern 7' of the present right-of-way <br />of Elliott Avenue, as said roadway is bounded on the <br />east by Frederick Boulevard and on the west by Deep <br />Creek Boulevard. It being intended that Elliott Avenue <br />shall retain a dedicated public street right-of-way of <br />66' in width as said street runs between Frederick Boule- <br />vard on the east and Deep Creek Boulevard on the west.'~ <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> 86-369 - Letter from the City Manager recommending adoption of <br /> resolution appointing viewers for closing of a portion of King <br />treet. <br /> <br /> "In 1976 City Council adopted an ordinance closing that portio~ <br />f King Street between Water Street and Crawford Street as part of <br />the then designated waterfront redevelopment plan. Subsequen~ to <br />that action, certain plats were recorded by PRHA which purported to <br />rededicate a portion of the street. <br /> <br /> The development of the property between this portion of King <br />Street and High Street by W. B. Meredith Co., Inc., provides for <br />this portion of King Street to be occupied by the parking garage <br />zomplex. <br /> <br /> Upon review of the recorded documents, the City Attorney has <br />recommended that the original street closure be reconfirmed by <br />in order to eliminate any potential title problems which <br />be raised in connection with this development. Therefore, I, <br />recommend adoption of th~ resolution to appoint viewers for this <br />street closure application." <br /> <br /> <br />
