October 14, 1986 right-of-way between Frederick Boulevard and Deep Creek Boulevard. Since that time, it has been determined that the appropriate right- of-way to be retained for this street should be 66' in width. The City has made application to close an additional 7' on either side of the present right-of-way in order to conform to the present traf- fic requirements. I recommend adoption of the resolution on your agenda tonight to appoint viewers pursuant to this application for closure of addi- tional right-of-way.on Elliott Avenue.' On motion of Mrs. Webb and seconded by Mr. Simpson, the follow- resolution was adopted, and by the following vote: "A RESOLUTION APPOINTING VIEWERS FOR CLOSING OF A PORTION OF ELLI©TT AVENUE. WHEREAS, the City of Portsmouth has made application to vacate ~lose and discontinue the hereinafter-described portion of Elliott and it appearing that Notice of Application and request for appointment of viewers has been duly advertised as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Richard D. Ottavio, Waldo Davis, William Choate, James H. Griffin, James L. Linehan be appointed viewers and that George N. Powers, Sr., and Matthew L. Peanort be appointed alternate viewers in the event one of the preceding viewers fails to participate, said viewers to view the hereinafter-described pot- of such street and to report to this Council in writing whether in their opinion any, and if any what, inconvenience would result in ziewing and closing the following: Elliott Avenue All those two certain strips of land, being the northern and southern 7' of the present right-of-way of Elliott Avenue, as said roadway is bounded on the east by Frederick Boulevard and on the west by Deep Creek Boulevard. It being intended that Elliott Avenue shall retain a dedicated public street right-of-way of 66' in width as said street runs between Frederick Boule- vard on the east and Deep Creek Boulevard on the west.'~ Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holley Nays: None 86-369 - Letter from the City Manager recommending adoption of resolution appointing viewers for closing of a portion of King treet. "In 1976 City Council adopted an ordinance closing that portio~ f King Street between Water Street and Crawford Street as part of the then designated waterfront redevelopment plan. Subsequen~ to that action, certain plats were recorded by PRHA which purported to rededicate a portion of the street. The development of the property between this portion of King Street and High Street by W. B. Meredith Co., Inc., provides for this portion of King Street to be occupied by the parking garage zomplex. Upon review of the recorded documents, the City Attorney has recommended that the original street closure be reconfirmed by in order to eliminate any potential title problems which be raised in connection with this development. Therefore, I, recommend adoption of th~ resolution to appoint viewers for this street closure application."
