83 <br /> <br />October 28, 1986 <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE C~TY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 29~64 AND 29-66 THEREOF, <br />PERTAINING TO PRIVATE DETECTIVES AND PRIVATE DETECTIVE <br />AGENCIES." <br /> <br />Ayes: Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> 86-387 Letter from the City Manager recommending adoption of <br />an ordinance to amend Ordinance No. 1986-37, Section ll(a) grid <br />Section Il(g) to enable proper calculation of overtime pay ~ate for <br />Firefighters and Police Officers under the Fair Labor Standards Act. <br /> <br /> "In view of the recently implemented requirements of the Fair <br />Labor Standards Act as they apply to local government, and our desi~ <br />to make the City of Portsmouth Classification and Pay Plan most <br />closely represent the intent of the Council with regard to Compen- <br />sation for all employees, the following changes are recommendeS: <br /> <br />Section il(a) Delete final sentence, "This allowance <br />will be paid quarterly commencing with the first fRscal <br />quarter after assignment." <br /> <br />Current language precludes the calculation oF <br />this allowance in the affected officer's over- <br />time calculation. Specifically, all allowances <br />qualifying as factors in overtime hourly rates <br />must be paid on a monthly basis. <br /> <br />2. Section ll(.g) Delete this section in its entirety. <br /> <br />This assignment, similar to the Police funeral <br />escort allowance deleted from this year's <br />Classification and Pay Plan, has been deter- <br />mined to be a regular Police assignment, and, <br />as such, not subject to a special allowance <br />payment. <br /> <br /> Your approval of the above changes will make our Class%fi <br />and Pay Plan comply with Fair Labor Standards Act requirement <br />Please let me know if you require any additional information. <br /> <br /> On motion of Mr. Simpson and seconded by Mr. Gray, the <br />ordinance was adopted on first and final reading, and by <br />ing vote: <br /> <br />"AN ORDINANCE FO AMEND THE CITY OF PORTSMOUTH, VIRGINIA, <br />CLASSIFICATION AND PAY PLAN, ORDINANCE NO. 1986-37, BY <br />AMENDING SECTION 11 (a) AND REPEALING SECTION 11 (g) <br />THEREOF, PERTAINING TO ADDITIONAL COMPENSATION - FIRE- <br />FIGHTERS AND POLICE OFFICERS." <br /> <br />Ayes: Corprew, Gray, Lucas, Simpson, Webb, Holley <br />Nays: None <br /> <br /> 86-388 - Letter from the City Manager recommending <br />an ordinance to amend the City Code by amending Section <br />raining to setback provisions. <br /> <br />ad,piton of <br />32 75 per- <br /> <br /> "The Portsmouth City Code (Section 32-75) provides a building <br />setback line of sixty (60) feet from the center line of Airline <br />Boulevard from High Street to the western city limits. Th~s setbacl <br />~rovision was established prior to 1961 before the constru~tion of <br />~-264. The intent was to retain an open corridor for a mai. or <br />thoroughfare in the event traffic demands warranted the wi~ening of <br />Airline Boulevard. According to the Director of Public Works, <br />developmen~ of 1-264 and other improvements have eliminated the nee~ <br />to widen Airline Boulevard and it is his recommendation that the <br />seback be reduced.
