January 23, 2018 <br /> <br />(b) The design and materials of buildings constructed in Lincoln Park/Lexington shall <br />be in substantial conformity with the elevations titled “Proposed Elevations, Lexington <br />Place”, prepared by Saunders & Crouse Architects and dated October 20, 2017, which <br />were submitted with the use permit application and are on file with the Department of <br />Planning, with the areas in red on the said elevations representing brick and the white <br />areas representing cementitious siding (like Hardieplank). <br /> <br />(c) All current requirements of the Zoning Ordinance, City Code, and other applicable <br />laws or regulations shall apply to the redevelopment of Lincoln Park/Lexington. <br /> <br />(d) All taxes/fees associated with the property and/or the use shall be paid when due. <br /> <br />4. That UP-16-01 granted on February 23, 2016 by City Council Resolution R- <br />16-07 is hereby rescinded and shall be of no further force or effect. <br /> <br />REVOCATION OF PERMIT: <br />5. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br />18-13(b): <br /> <br />“RESOLUTION GRANTING A USE PERMIT (UP-17-12) TO BOUNTIFUL BLESSINGS <br />DAY CARE, LLC TO OPERATE A CHILD DAY CARE CENTER AT 2115 HIGH <br />STREET. <br /> <br /> <br />WHEREAS, <br /> Brian K. Johnson, authorized agent for Bountiful Blessings Day Care, <br />LLC, the owner of the subject property, has made application pursuant to Section 40.1- <br />2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit <br />to operate a child day care center at 2115 High Street, Portsmouth, Virginia; and <br /> <br />WHEREAS <br /> , the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />WHEREAS <br /> , the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in the <br />zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> <br /> <br /> <br /> <br /> <br />
