That Bountiful Blessings Day Care, LLC is hereby granted a use permit <br />pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to <br />operate a child day care center at 2115 High Street, Portsmouth, Virginia, being more <br />particularly described as: <br /> <br />UP-17-12 <br /> <br />2115 High Street <br />(Tax Parcel 0171-0160) <br /> <br />ALL THAT certain lot, piece or parcel of land, lying, situate and being in the City of <br />Portsmouth, Virginia, and being known, numbered and designated as Parcel B, as shown <br />on that certain plat entitled, “Minor Resubdivision of Property of Westview Building <br />Corporation, Located at #2111 & #2115 High Street, Portsmouth, Virginia”, dated June <br />19, 1990, prepared by Hoggard/Eure Associates as recorded in the Clerk’s Office of the <br />Circuit Court of the City of Portsmouth, Virginia, in Map Book 15, at page 43. <br /> <br />BEING the property conveyed to Bountiful Blessings Day Care, LLC by Deed from GHH <br />Loudoun High LLC dated August 1, 2016 and recorded in the Clerk’s Office of the <br />Portsmouth Circuit Court as Instrument Number 160007547. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Occupancy of the child day care center shall be limited to no more than fifty (50) <br />children. The facility shall not provide care for infants (children under the age of 2 ½ <br />years). <br /> <br />(b) The days and hours of operation for the child day care activities shall be limited to <br />Monday through Friday no earlier than 6:00 a.m. and no later than 6:00 p.m. <br /> <br />(c) Outdoor play shall be limited to Monday through Friday no earlier than 8:00 a.m. <br />to no later than 6:00 p.m. The proposed outdoor play area shall comply with Portsmouth <br />City Code Section 40.1-4.3(B)(1)(iii). <br /> <br />(d) The proposed parking area shall comply with Portsmouth City Code Section 40.1- <br />4.3(B)(1)(iv). The applicant shall maintain at least seventeen (17) off-street parking <br />spaces for the drop-off/pick-up of children and staff parking. The spaces shall be <br />configured so that children do not have to cross vehicular travelways to enter or exit the <br />child day care center facility. Any reduction in parking spaces may result in a reduction <br />in the number of children allowed. <br /> <br />(e) Prior to the issuance of the Zoning Clearance for the child day care center facility, <br />the applicant shall obtain the approval of a site plan that provides a code-compliant <br />outdoor play area and the required parking, including required accessible parking spaces <br />and associated accessible signage and accessways, in support of the facility. <br /> <br />(f) The existing driveway access from High Street shall be permanently closed prior <br />to initial operations. Street parking on the High Street frontage shall be prohibited. <br /> <br />(g) The facility shall be operated in compliance with applicable codes, ordinances and <br />regulations of federal, state and local government, including, but not limited to, the Virginia <br />Uniform Statewide Building Code, and all required licenses and permits shall be obtained <br />and remain in effect during the operation of the child day care center. <br /> <br />(h) All taxes/fees associated with the property and/or the proposed use shall be paid <br />when due. <br /> <br />REVOCATION OF PERMIT: <br />4. Violation of any of the above conditions may <br /> <br />serve as grounds for revocation of the use permit by City Council.” <br /> <br /> <br /> <br /> <br /> <br /> <br />
