January 23, 2018 <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in the <br />zoning district(s) of surrounding lands; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br /> 2. That Portsmouth Redevelopment and Housing Authority is hereby granted <br />a use permit pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, <br />Virginia (2006) for the construction of multi-family housing at 1 Lexington Drive, <br />Portsmouth, Virginia, said property being more particularly described as: <br /> <br />UP-17-11 <br /> <br />1 Lexington Drive <br />(Tax Parcel 0145-0010) <br /> <br />ALL THOSE CERTAIN lots, pieces or parcels of land, being, lying and situate in the City <br />of Portsmouth, Virginia, known as the Lincoln Park public housing community property <br />and generally described as follows: <br /> <br />COMMENCING at the northeast intersection of Deep Creek Boulevard and Graham <br />Street; thence northeasterly along the northern line of Deep Creek Boulevard to the <br />northwest intersection of Deep Creek Boulevard and Columbus Avenue; thence <br />northwesterly along the western line of Columbus Avenue, inclusive of the closed right of <br />way formerly known as Lexington Drive, to the southeastern corner of the Dale Homes <br />public housing community (2300 Columbus Avenue, Tax Parcel 0167-0040); thence <br />westerly along the southern line of the Dale Homes public housing community to the <br />northeastern terminus of Graham Street; thence southeasterly along the eastern line of <br />Graham Street to the northeast intersection of Deep Creek Boulevard and Graham Street, <br />the point of beginning. <br /> <br />BEING the Lincoln Park public housing community property. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The development of the site shall be in substantial conformity with the concept plan <br />titled “Development of Lincoln Park”, prepared by Saunders & Crouse Architects and <br />dated October 20, 2017, which was submitted with the use permit application and is on <br />file with the Department of Planning, except as may be necessary to comply with any <br />modifications required by City Ordinances and the City Code during site plan review and <br />approval. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
