September 26, 2017 <br /> <br />WHEREAS, <br /> no local match is required as a condition of receiving funds for the <br />Project; <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute and deliver the <br />Programmatic Project Administration Agreement for the Traffic Signal Upgrades Project <br />in such form as VDOT may require, and to execute such other agreements or addenda <br />between the City and VDOT as are necessary or desirable to obtain funding and <br /> <br />implement the Project.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Psimas, Whitaker, Rowe <br />Nays: None <br /> <br />17 - 431 - Adoption of a resolution authorizing the city manager to approve a change <br />order totaling more than 25% of the construction contract with Crofton <br />Construction Services, Inc. for the replacement of Area 4 of the Portsmouth <br />seawall. <br /> <br /> <br />Background: <br /> <br /> By city code, no fixed-price contract shall be increased by 25 percent of the amount <br />of the contract or $50,000, whichever is greater, without consent from City Council. <br /> <br /> The Replacement of the Portsmouth Seawall Replacement in Areas 3 and 4 were <br />advertised at the same time because of the similar construction in both seawall segments. <br /> <br />Discussion: <br /> <br /> The city received bids to replace the Portsmouth Seawall in Area 3 and Area 4 with <br /> <br />the option to execute one contract for both segments or have separate contracts. <br /> <br /> Seawall Area 3 is the section between Admirals Landing and the Renaissance. <br /> <br />Seawall Area 4 is the section between High Street and Ocean Marine. <br /> <br /> There was insufficient funding to award the Seawall Replacement as one <br />project/contract. The project for Area 3 was awarded its entirety. Area 4 was awarded <br />such that approximately 544 feet of the seawall in that section was included within the <br /> <br />original scope of work. <br /> <br /> The 2018 CIP provided additional funding for the replacement of the seawall, <br /> <br />including the remainder of Area 4 (approximately 350 feet). <br /> <br /> At the request of the city, the current contractor on for the Seawall Replacement <br />project submitted a change order to complete the portion of Area 4 that is not currently <br /> <br />under contract. <br /> <br /> This change order is in agreement with the contractor’s original bid pricing for the <br />work on Area 4, which is less than the bid of the next low bidder from the original <br />advertisement. Proceeding by change order is also advantageous because this <br /> <br />contractor is onsite and has familiarity with the seawall. <br /> <br />Financial Impact: <br /> <br /> The current contract for Area 4 is $4,483,612. The additional cost to complete <br /> <br />Area 4 is $2,883,205.88. <br /> <br /> <br /> These funds are available in the Seawall Reinforcement CIP. <br /> <br />Recommended Action: <br /> <br /> Adoption of the resolution. <br /> <br />Next Steps Following Council Action: <br /> <br /> <br /> Execute Contract Change. <br /> <br />Motion by Mr. Clark, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />“RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE A CHANGE <br />ORDER TOTALING MORE THAN 25% OF THE CONSTRUCTION CONTRACT WITH <br />CROFTON CONSTRUCTION SERVICES, INC.
