September 26, 2017 <br /> <br />WHEREAS, <br /> in 2016 the City solicited bids for the replacement of Area 4 of the <br />Portsmouth seawall, which is the section of the seawall between High Street and the <br />Ocean Marine Facility; and <br /> <br />WHEREAS, <br /> Crofton Construction Services, Inc. submitted the low bid; and <br /> <br />WHEREAS, <br /> the City entered into a contract with Crofton Construction Services, <br />Inc. for the replacement of a portion of Area 4 of the seawall dated July 15, 2016; and <br /> <br />WHEREAS, <br /> due to funding limitations at the time of contract execution, the initial <br />scope of work in the contract was limited to approximately 544 linear feet out of the total <br />894 linear feet contained in Area 4; and <br /> <br />WHEREAS, <br /> as part of the FY 2018 Capital Improvement Fund budget adopted on <br />May 9, 2017 City Council appropriated additional funding sufficient for the completion of <br />replacement of the entire 894 linear feet contained in Area 4; and <br /> <br />WHEREAS, <br /> at the request of the City, Crofton Construction Services, Inc. has <br />submitted a proposed change order to revise the contractual scope of work accordingly; <br />and <br /> <br />WHEREAS, <br /> the additional price to add the remaining 350 linear feet to the contract <br />scope is $2,883,205.88, which is consistent with the contractor’s original bid price; and <br /> <br />WHEREAS, <br /> the initial contract price for the first 544 linear feet was $4,483,612; <br />and <br /> <br />WHEREAS, <br /> the change to the project scope will therefore result in additional <br />material and construction costs that will exceed 25% of the original contract amount; and <br /> <br />WHEREAS, <br /> Section 12-183 of the City Code requires Council approval to exceed <br />an original contract amount by more than 25% or $50,000, whichever is greater; and <br /> <br />WHEREAS, <br /> it is projected that the final project cost will be $7,366,817.88, and <br />funding for the additional project costs is available in the Capital Improvement Fund <br />budget. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council of the City of Portsmouth, <br />Virginia that, pursuant to Section 12-183 of the City Code, the City Manager is authorized <br />to expend the additional funds necessary to add the remaining 350 linear feet to the scope <br />of work for the Area 4 Seawall Replacement contract, and to complete the replacement <br />” <br />of the entire Area 4 of the seawall. <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Psimas, Whitaker, Rowe <br />Nays: None <br /> <br />- New Business - <br /> <br />17 - 432 - Boards and Commissions <br /> <br />Vice Mayor Cherry offered the following nominations: <br /> <br />Board of Building Code Appeals <br />William Hargrove III to be reappointed to a term ending August 31, 2021. <br /> <br />Board of Zoning Appeals <br />Mary Murray to be reappointed to a term ending December 31, 2022. <br />Gary Bunting to be appointed to fill a term ending December 31, 2020, replacing Leon <br />Boone. <br /> <br />Economic Development Authority <br />Cathy Revell to be reappointed to a term ending December 31, 2021. <br /> <br /> <br /> <br /> <br />
