Donna Sayegh, 3104 Garland Drive, spoke in opposition to this item. <br /> <br />Motion by Ms. Psimas, and seconded by Ms. Lucas-Burke, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />“ORDINANCE TO RE-APPROPRIATE UNEXPENDED FUNDS FROM THE FY 2017 <br />PORTSMOUTH PUBLIC SCHOOLS GRANT FUND BUDGET IN THE TOTAL AMOUNT <br />OF $328,447 INTO THE FY 2018 PORTSMOUTH PUBLIC SCHOOLS GRANT FUND <br />BUDGET.” <br /> <br />Ayes: Cherry, Clark, Lucas-Burke, Moody, Psimas, Whitaker, Rowe <br />Nays: None <br /> <br />17 - 397 - Adoption of an ordinance to re-appropriate unexpended funds from the <br />FY 2017 Portsmouth Public Schools (PPS) General Fund and Risk Management <br />Fund budgets in the total amount of $3,457,539 by classification to the overall and <br />First Quarter FY 2018 PPS General Fund budget. <br /> <br />Background: <br /> <br /> The Portsmouth School Board has requested that the city re-appropriate the <br />following amounts which were appropriated in FY 2017 but not expended by June 30, <br />2017: $841,840 of General Fund funds which were neither encumbered nor expended, <br />$888,628 of Risk Management funds which were neither encumbered nor expended, and <br />$5,038,537 of General Fund funds which were encumbered but not expended (note that <br /> <br />these figures are preliminary, and may be adjusted for financial reporting and external <br />audit purposes). Of these amounts, the School Board has requested that $750,000 be <br />appropriated to the Education category of the FY 2018 Capital Improvement Fund and <br />that the balance be appropriated to the FY 2018 Portsmouth Public Schools General <br />Fund. <br /> <br /> Virginia State Code Section 22.1-100 states that “all sums of money derived from <br />the Commonwealth which are unexpended in any year in any school division shall revert <br />to the fund of the Commonwealth from which derived unless the Board of Education <br />directs otherwise. All sums derived from local funds unexpended in any year shall remain <br />a part of the fund of the governing body appropriating the funds for use the next year, but <br />no local funds shall be subject to redivision outside of the locality in which they were <br />raised.” <br /> <br /> As stated in City ordinance 2016-30, funds encumbered but unpaid by the end of <br />the fiscal year will be deemed unspent appropriations that will require re-appropriation by <br />the City Council. <br /> <br /> A City Council Resolution, passed June 12, 2001, stated that unused (unassigned) <br />fund balance of the School Division would be divided as follows: 75% to PPS and 25% to <br />the City. <br /> <br /> The PPS General Fund is appropriated by category/ classification and on a <br />quarterly basis. <br /> <br /> <br /> <br /> <br />
